5.  ਫੈਸਲਾ Brief History This is a LS consumer having sanctioned load as 1632.609 KW.This consumer was charged Rs:347679/- as per H/M no:58,dt:5.12.12 issued by Supdt/RAP, Focal Point, Ludhiana. As per this half margin, the audit party had treated this unit as PIU based on the report of Enforcement vide ECR No:2/868 dt: 15.5.11 & ECR No:9/870 dt: 11.6.11. As per this ECR one number 100 KW billet heater without nameplate was found lying in defective condition in the factory premises. The audit party based on this report treated this unit as PIU & as per CC:38/09 withdrew the Power factor incentive given to the consumer by treating it as general category industry from 10/09 to 9/11. Proceedings The consumer in his re-presentation pleaded that the billet heater lying in his factory was not working & was defective since long. Moreover while getting his CD extended from 900 KVA to 1000 KVA vide A&A No: 52141 dt: 3.7.09 in the load detail given there was no billet heater as verified by SDO on the test report dt: 12.10.09 The case was deliberated in the previous meetings & it was decided to get the connection checked again by ASE/Focal Point, because in the test report given by the consumer, there were certain continuous furnaces & normalizing furnaces. Commttee directed ASE/Focal Point to visit the premises & submit report. Accordingly, ASE/Focal Point visited the premises on dt: 17.5.12 & submitted report vide LCR No: 43/642. As per this report, there was one number 62.98 KW chamber & 8 numbers 19 KW chambers, which are being used for treating the material by heating for forging & these work on normal voltage & normal frequency. This connection was earlier also checked on dt: 16.4.11 vide LCR No: 41/642 by ASE/Focal Point, where it is mentioned that there was no billet heater in the premises. Decision The case was deliberated by the committee & in view of CC:28/12 unanimously decided that this connection should be treated as general category consumer instead of PIU. Therefore, any amount deposited by the consumer should be refunded through his future energy bills.
