5.  ਫੈਸਲਾ Brief History The petitioner is a LS Category consumer having Sanctioned Load as 6885.63 KW and CD as 3950 KVA. Supdt/RAP vide Half Margin no. 86 dt. 8.11.11 directed to withdraw the PF incentive given to the consumer by treating it as GENERAL CATEGORY Industry while as per CC no. 38/2009 the billet heater load is to be treated as Power Intensive Unit and, thus, the amount of Rs. 1357447 was directed to be charged which was given to the consumer as PF Incentive from 10/2009 to 3/2011. Proceedings The consumer in his representation pleaded that his connection was released as GENERAL CATEGORY consumer because he has mentioned billet heater load in his A & A form. The consumer further told the committee that he converted his supply from 11 KV to 66 KV in 7/2010 and CE/Commercial had sanctioned load in General Category in 7/2010 while approving the A & A Form i.e. after issue of CC no. 38/2009. The consumer further intimated that he was never informed about the change of status of his industry from General Category to PIU. It was only in 6/2011 that ASE/Focal Point vide memo no. 1241 dt. 23.6.11 informed the consumer that the category of his connection has been changed from General to PIU and asked to observe the Weekly Off Days as applicable on Power Intensive unit. The consumer also informed the committee that a writ has already been filled in PSERC, Chandigarh to determine whether the billet heater load is Power intensive or it falls in GENERAL CATEGORY and requested for keeping the case pending till the final disposal of petition by the PSERC, Chandigarh. 2/5 M/s Highway Industries Account no: FP-51/0714 Obervations of Committee The committee observed that PSPCL has appointed CPRI, Bangalore to study the behavior of billet heaters for purpose of determination as PIU or not? Accordingly, CPRI, Bangalore submitted a report to PSERC, Chandigarh & PSPCL, but till date this issue has not been decided by PS ERC. In the mean time, CE/Commercial vide CC no. 28/12 issued a circular according to which: “All the LS Consumers having billet heater load up to 25 % of connected load or 500 KW, whichever is higher may be considered as General Category Consumers.” Therefore. CC no. 38/2009 was amended to the extent as stated above and these instructions were applicable w.e.f. 24.12.11. This case was kept pending by the committee waiting for the disposal of petition by PSERC, Chandigarh. Now, the PSERC has decided the issue. In view of PSERC order, dt.28.10.13 in petition no. 3 of 2012, a CC 27/2014 dt.29.05.14 has been issued by CE/Comm. As per CC “all LS consumers where the Induction Billet Heaters/Surface Hardening Machines are installed shall be treated under PIU category w.e.f.1.1.2014. This circular supersedes CC no. 28/2012 dt. 06.09.12.” Decision The case was deliberated by the committee in the presence of Sh.G.S.Sandhu and Sh.Jaswant Singh and in view of CC no. 27/2014, CC no.28/2012, 38/2009 and LCR no. 3/642 dt. 16.4.2011 prepared by ASE/Focal Point wherein out of checked load of 3305 KW, billet heater load of 1930 KW was checked which was more than 25 % of Sanctioned Load. After detailed deliberations, the committee decided that the amount has been correctly charged to the consumer because as per CC no.38/2009 dt.29.10.2009, it has already been decided to consider the load of billet heaters as Power Intensive Load. The consumer has been charged power factor incentive availed by him from 10/2009 to 03/2011. The amount stands recoverable because as per CC no. 28/2012 also because the relief was given to only those billet heater consumers whose billet heater load was only 25 % of connected load or 500 KW, whichever is higher. In this case of consumer, the load of billet heaters is more that 25 % of total Connected Load. So, in the light of CC 27/2014 dt. 29.05.2014 & as per standing instructions of 38/2009 the power factor incentive wrongly given to the consumer from 10/2009 to 3/2011 amounting to Rs. 1357447/- is recoverable.
