5.  ਫੈਸਲਾ 1. The petitioner is having NRS connection bearing account no CS01/0090 in the name of M/s Spice communication with sanctioned load of 24.16 KW. 2. The reading of KWH meter recorded on dt 15.03.12 was 204502 whereas previous readings was 98561 so the consumption comes as KWH 105851 units. The computer prepared the bill amounting to Rs. 745021/-. The consumer challenged the meter by depositing Rs.450/- vide BA16No.223/933 dt 18.04.12 The meter was changed vide MCO no.112873 dt 18.04.12 effect on 15.06.12 and was sent to ME lab for further checking. The meter was found ok and DDL was taken. The consumer challenged the amount charged and requested CE/Central to consider the case in Zonal DSC which was accepted vide Memo No 9965/67 dated 18.9.12. The consumer deposited 20% of disputed amount of Rs.149004/- vide CCR No.9699274 dated 29.09.12 Proceedings ZDSC heard this case on 3.10.2012, 26.10.12, 16.11.2012 and finally on 3.12.12 when the case was closed after passing speaking order. The petitioner submitted his petition on dated 3.10.2012 in which he stated that his average consumption was usually 6000 units but in the month of March it was 105851 units due to internal problem in the meter. PO in his reply has stated that the consumption recorded during 3/2012 was 105851 units. The bill was prepared as per consumption. It was correct that the average consumption of the connection is between 5000 to 8000 units per month approximately, but as per ME report result of the meter was O.K. In the earlier meeting held on 26.10.2012, PO was directed to submit the comprehensive report of DDL, consumption data for last three years and analysis of X code for the month of 11/2010. The same was presented by PO in the next meeting. After perusal of DDL it was found that meter was 6 digits but the billing was done on 5 digits. The meter of the consumer was got checked in ME Lab. As per letter of SDO ME Ludhiana the meter readings of the meter was 24306.63 KWH and 260747.4 KVAH and MDI was 19.40. The meter has six digits reading as per the consumption data produced by PO. Meter completed X Code N 11/2010 where as the reading of the meter was six digit as per above letter of SDO/ME Ludhiana. . The meter of the consumer was produced in the meeting and committee verified the readings given by AE/ME. The committee deliberated the issue in length. The readings recorded on different records are i.e. on ME Lab report No 28/425 dated 5.9.12 224305.25 KWH 260746.0 KVAH, on AE/ME letter no 24306.63 KWH 260747.4 KVAH and on DDL 124305.56 KWH 160746.44 KVAH. The meter is found to be defective as the reading of KWH was in five digits whereas it was recorded in six digits when the meter was dismantled from the consumer premises and checked in ME Lab vide challan No. 1 Dated 5-9-12. Conclusion. It was decided by the committee that account of the consumer for the month of 3/2012 may be overhauled on the basis of last year consumption of the same month and fresh notice be issued accordingly. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.
