5.  ਫੈਸਲਾ Sh.K.S.Paunta, legal counsel of consumer attended the meeting. The case was charged Rs: 277729/-. This connection was checked by ASE/Enforcement, Ludhiana on dt 11.2.11 on the verbal request of AAE/Focal Point Divn. Ludhiana vide ECR No-2/262 dt: 11.2.11. As per the report of the Enforcement the KVAH meter had jumped almost 4 Lac units as compare to previous reading & its MDI which was earlier recorded as 80.74 had also come down to 59.14 & declared the meter to be defective. The meter was changed & taken to ME Lab vide store challan no: 1110228/19784 dt: 8.3.11. Supdt/Audit Party vide half margin no:25 dt: 16.4.12 overhauled the accounts of consumer by taking the difference of units in view of the final reading of KWH recorded on the challan & the reading up to which the billing had been done previously. Since the difference in KVAH reading was more than 4 Lac units, it was treated to be defective meter. The counsel of consumer in written re-presentation intimated that the reading of the consumer was recorded by JE during monthly reading on dt:9.2.11 & it was found as under:- KWH-452216 KVAH-506922 But the readings recorded by ASE/Enforcement on 11.2.11 in his LCR were as under:- KWH- 505070.8 KVAH-909158.9 & the readings recorded while effecting MCO on 22.2.11 were as under:- KWH- 508589.6 KVAH-912830.1 Consumer pleaded that in just 2 days i.e. from 9.2.11 to 11.2.11, it was not possible to consume 56373 units, while the KVAH reading had gone up more than 4 Lac units. To further clarify the matter AAE Sh. Ashok Kumar Focal Point Divn. Ludhiana was called in the meeting along with Sh. Daljit Singh(ASE), who prepared the LCR to know their version. Sh. Ashok Kumar (AAE) informed the committee that after recording the monthly reading on 9.2.11, he received the phone call from consumer that his meter had jumped. After verification at site he informed the concerned ASE/Enforcement, who visited the site on 11.2.11 & prepared the LCR. The committee heard to the oral & written arguments given by consumer counsel, studied the consumption pattern & unanimously came to conclusion that it was a case of meter jumping as it is practically not possible to record consumption of 56373 units in two days. Therefore the accounts of the consumer in that month may be overhauled by taking the actual recorded consumption of 3/12, which is 10223 units. Revised calculations should be made & the revised bil be issued to consumer accordingly. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.

1 Fri 16, Nov 2012  The case was deliberated by the committee & PO was directed to call AAE/JE, who recorded the monthly reading on 9.2.11 along with reading record & ASE/Enforcement also who prepared ECR no:2/862 dt:11.2.11. The case was deferred.
