5.  ਫੈਸਲਾ Sh. R.S. Behal attended the meeting on behalf of consumer. The amount of Rs: 1,58,757/- in this case relates to demand surcharge already charged from the consumer from 5/09 to 7/09. P.O. informed that in this case, the consumer was issued bill of 8/09 for 3,59,730/-, which included demand surcharge & power factor surcharge. The consumer had approached ZDSC against this amount & ZDSC had decided the case on 6.12.10 & the decision in brief is as under:- “It was concluded that meter had made wrong recording of KWH & KVAH reading due to its defective software & thus, the amount charged to the consumer on account of PLV & WOD violation was not chargeable. Since the ME Lab had declared the meter to the defective therefore, the amount charged on account of excess MDI recorded in the August-09 is also not chargeable. However the consumption recorded in 8/2009 was found to be OK & only consumption charges are recoverable from the consumer.” The consumer informed the committee that the excess MDI recorded for the month of May, June & July was also on account of defective MDI as is clear from MDI recorded of consumer in the last three years. Committee deliberated the case & observed that the excess MDI recorded was due to defective meter declared in ME Lab. Moreover ME lab has clearly mentioned that magnetic sensor of the meter had become defective & meter was recording the reading on Imax & was defective. After deliberation committee unanimously decide that the excess MDI recorded was due to defective meter & thus the amount of Rs: 1,58,557/- earlier charged as demand surcharge is refundable. Consumer should be informed accordingly & amount be adjusted in further energy bills.

He was told to submit petition within one week. P.O. Shall prepare point-wise reply. The case was deferred.
2 Fri 22, Jun 2012  Sh. R.S.Behal attended the meeting on behalf of consumer.
Consumer had already submitted his petition & ASE/Focal Point submitted para-wise reply also. Committee deliberated the case & directed P.O. to submit the details of maximum demand recorded for last 5 years & also to intimate why Power Factor Incentive surcharge was levied for the month of 5-6-7/2010. The case was deferred.
3 Sat 04, Aug 2012  Nobody attended the meeting. However P.O. presented MDI record for the last 5 years. The case was kept pending for further study by the committee.
