5.  ਫੈਸਲਾ The case came up for hearing before the committee again on 12-10-12. Er. Karamjit Singh Khehra, Dy. CE/DS Circle Nawanshehar presented the case before the committee for discussion. Sh. Vijay Talwar was present before the committee on behalf of the consumer. Mr. Talwar has stated that he has already received copies of the documents applied for by him excepting certain documents as mentioned in his application. Er. K.S. Khehra, Dy. CE/DS Circle, Nawanshehar has stated that the documents which have not been supplied to the representative of the consumer are neither in his possession nor under his control. Er. Khehra has further stated that these documents are not relevant to this case. He has further invited the attention of the Committee to CC No. 28/2012 dated 06-09-12 regarding billet heating load. The directions has contained in this Circular are reproduced as under:- “All the large supply consumers having Billet Heater Load upto 25 per cent of connected load or 500KW, whichever is higher, may be considered as General Category Consumers.” Accordingly CC No. 38/2009 stands amended to that extent. These instructions are applicable w.e.f. 24-12-2011 and will remain applicable till any further directions of Hon’ble PSERC in this regard. The representative of the consumer has argued the case at length and has tried to distinguish his case outside the operation of CC No.28/2012 dated 06-09-12. He has not been able to put forth any cogent facts or any supporting documents relating to the case which may distinguish his case from CC No.28/2012 dated 06-09-12. The representative of the consumer has further tried to distinguish his case that the running induction billet heating load of the consumer is 830KW out of total sanctioned load of 3313.930KW which works out to be 25.045 per cent and is above the ambit of the instructions of PSPCL. Nothing else has been brought forwarded by the representative of the consumer. The Committee is of the view that this case is fully covered under CC No.28/2012 dated 06-09-12. Accordingly, the case is decided and demand raised in this case is fully justified and covered within the above instructions. The account of the consumer may be overhauled and the amount be charged alongwith interest accordingly.
