5.  ਫੈਸਲਾ The case came up for hearing before the committee again on 21-09-12. Er. Darshan Singh, Dy. CE/DS Circle Kapurthala presented the case before the committee for discussion. Sh. S.K. Vatta was present on behalf of the consumer. This case has been discussed in detail. Dy. CE/DS Circle, Kapurthala vide his Memo No.23462 dated 20-09-2012 has reported that the consumer has not supplied the Production and Sales data as demanded in the last hearing. Mr. Vatta has further submitted that he does not want to produce anything more and submitted a petition which has been placed on record. This petition does not disclose anything further in the case and is silent regarding the Production/Sales Data as asked for from him in the last meeting. Er. Y.P.S. Bath, ASE/MMTS-1, PSPCL, Jalandhar appeared before the Committee. He stated that the meter of the consumer got erratic and went into on & off mode and could not record the readings/consumption at various points of time, as seen from the DDL Printouts. The accuracy of the meter could not be determined on 09-05-2012 due to above defects as per ECR No.45/1409 dated 09-05-2012 recorded at that time by ASE/MMTS-1, PSPCL, Jalandhar. The MTE Set was used to check the accuracy of the defective meter, which could not be completed at that time. After detailed discussions and facts of the case, it is decided that the amount already charged is justified and is on the basis of average, which is as per instructions of the PSPCL. Accordingly, the account of the consumer may be overhauled. Interest/surcharge on the recoverable amount may also be recovered as per rules/instructions of PSPCL.
