5.  ਫੈਸਲਾ Brief History: The petitioner has permitted load of 1200KW during peak load hours. The petitioner wants the refund of PLE charges charged to him for the restricted load. As CBC charged the PLE charges on the permitted load and not deducted the restricted load. As per PR circular no. 3/2007 dt. 7.6.2007 and 6/2010 dt. 31.5.2010, PLE charges are not to be recovered on weekly off days. The petitioner said that he had written to the ASE/CBC for the refund of these charges which was not refunded to him yet. Now ASE/CBC has started calculating and levying PLE charges after deducting the restricted load from the permitted load w.e.f 10.4.2012 (17.3.2012 in petitioner’s case). The petitioner requested before CE/DS to refund Rs.371560/- of PLE charges already charged to him. The request of the petitioner was accepted and the case was considered to be heard in ZDSC vide memo no 9823/25 dt. 13.9.12. ZDSC heard this case on 3.10.2012, 26.10.12, 16.11.2012and finally on 3.12.12 when the case was closed after passing speaking order. The petitioner submitted his petition before ZDSC and explained his case in length. He stated that as per Conditions of Supply applicable from 1.4.2010, Para 1(b) of Annexure 20 clearly provided that PLE charges are to be calculated on the permitted load minus restricted load even in cases where the permitted load exceeds 100KW. PR circular no 3/2007 dt. 7.6.2007 and PR circular no. 6/2010 dt. 31.5.2010 contemplate that PLE charged are not to be recovered for weekly off days. But CBC was not deducting the restricted load and was charging PLE charges on the total load. He brought the instructions to the notice of ASE/CBC and requested him to refund the excess charged amount. ASE/CBC started calculating and levying the PLE charges correctly after deducting the restricted load from the permitted load, but no refund was given to him for the already deposited amount. PO submitted parawise reply on the petition of the petitioner and stated that ASE/CBC wrote for the adjustment of the charges charged by them on the restricted load from 1.4.2010 to 10.4.2012 in respect of each consumer at the level of sub-division in concurrence with Audit organization. Further he stated that as per petition of the consumer the excess charges of peak load violation and weekly off days as per directions of Zonal Dispute Settlement committee has been work out by Sr.Xen/Estate. The allowed peak load exemptions has also been verified from time to time and the calculations are in order. Committee, after going through the petition submitted by the petitioner, calculation sheet and PR circulars referred in the case, decided that the refund claimed by the petitioner for the period 1.4.2010 to 10.4.2012 is in order as per the calculations submitted by ASE/Op Estate Division. RBS may be got prepared from CBC of the amount to be refunded.
