5.  ਫੈਸਲਾ The case came up for hearing before the committee again on 21-09-12. Er. Darshan Singh, Dy. CE/DS Circle Kapurthala presented the case before the committee for discussion. Sh. Amritpal Singh, Partner was present before the Committee. This case has already been discussed in detail and was adjourned on the last date on the request of the Dy. CE/Sales-2, PSPCL, Patiala for purpose of verifying whether there are any instructions on the subject of this case, as the consumer had failed to submit his requisite undertaking to run his Rice Sheller which was a pre-condition as per Commercial Instructions prevailing at that time. Er. J.S. Multani, Dy. CE/Billing, PSPCL, Patiala has confirmed that the charges worked out in this case are justified as per ESIM-2011 Appendix to Section-IV General Condition of Tariff No. 18.3(a) Billing of Seasonal Industry read with CC No.26/10 & 31/10. The consumer has not produced any further facts or proof in this case. It is, therefore, decided that the charges worked out and charged in this case are fully justified. The account of the consumer may be overhauled, accordingly as per instructions of the PSPCL. Interest/surcharge on the recoverable amount may also be recovered as per rules/instructions of PSPCL.
