5.  ਫੈਸਲਾ Sh. Nitin Talwar appeared before the committee on behalf of the consumer. The meter of the consumer was checked by MMTS Khanna vide ECR No. 48/1889 dated 12.9.2012 on his request. It was reported that one phase of the meter was disconnected from pole, the display of the meter was not scrolling and was stand still and there was flash on the screen. As such it was recommended to change the meter. The meter was replaced on 22.9.2012 vide MCO No. 1/100572 dated 20.9.2012. At the time of replacing the meter MDI was recorded as 833.2 KVA while the sanctioned demand was 333 KVA. Accordingly demand surcharge of 3,75,150/- was charged to the consumer. The petitioner instead of depositing the amount requested CE/DS to consider his case for ZDSC which was accepted vide Memo No 10861 dt. 18.10.12. The case was heard in ZDSC meetings dated 16.11.12, 3.12.12 and finally decided on dated 3.1.2013. Consumer in his petition stated that his connection was disconnected on dated 11.9.2012 on the diorections of PPCB and was restored on 21.9.2012 at 5 P M after getting clearance from PPCB. On 22.9.12 the mill was started at 8:00AM and after entering the meter room it was observed that the meter was recoding 196.7 MDI. As such he stopped the work and closed the mill. After that around 11:00AM the meter was recording 208 MDI. He further requested that this was due to fault in MDI and the amount charged to him should be waived off. PO stated that the MDI recorded at the time of change of meter was 208.3 x 4=8.33.2 as the multiplying factor of the meter was 4. The sanctioned CD of the petitioner is 333KVA and he was charged Rs.375150/- (833.2-333=500.2x750) as demand surcharge. The Committee instructed the PO in the last meeting on dated 3.12.2012, to get the DDL which was not taken on dated 12.9.12. Accordingly same was taken on dated 2.1.2013. The Committee scrutinized the DDL and the consumption data of the last three years and it was observed that the meter inadvertandely recorded the MDI which is not commensurate to the other parameters. Moreover, the capacity of transformer installed at consumer premises is 500 KVA which is physically verified by Additional S.E./Mandi Gobindgarh. The committee after scrutinizing all the record and consumption data observed that highest ever MDI recorded i.e. 397.6 during 5/2012 is to be taken instead of 833.2 KVA to overhaul the account of the petitioner. Fresh notice may be served upon to the petitioner.

The committee asked the consumer to submit the petition and further instructed P O to submit parawise reply to the petition and also supply copy of DDL dated 12.9.2012 and consumption data alongwith readings and reading dates. The case is deferred.
