The case came up for hearing before the committee on 06-07-12. Er. Gopal Sharma, SE/DS Circle Jalandhar presented the case before the committee for discussion. Sh. Jaswinder Singh, Chief Supervisor on behalf of the consumer has submitted an application signed by Dr. R.S. Chahal for seeking adjournment of this case. This case relates to refund of 7.5 per cent rebate. This case is exactly on the similar grounds and facts, as of M/s. Baba Kashmira Singh SGL Hospital Jalandhar & M/s Mayor World School Jalandhar decided by the ZDSC today holding that the rebate is not permissible to be allowed in those cases. As the facts of this case are exactly the same; accordingly this case is also decided holding that the rebate in this case is not permissible and this consumer is not elgible for this rebate in lieu of the instructions contained in memo No. 15132 dated 26-03-2010 and memo No. 797/829/Tariff dated 15-06-2012. Accordingly, the Committee decides that as per CC No. 36/2006 (General Condition of Tariff Clause No. 13.5), amount be charged by the concerned office as per PSPCL instructions. Accordingly, the Committee decided the case. The account of the consumer may be overhauled. Interest on the recoverable amount may also be recovered as per rules/instructions of PSPCL.
