5.  ਫੈਸਲਾ This case again came for hearing on 23-01-2013. Er. Darshan Singh Deputy Chief Engineer, DS Circle, PSPCL, Kapurthala presented the case before the committee for discussion. Sh. P.S. Saini, DGM, Sh. Parveen Kumar Deputy Manager and Sh. Balwinder Kumar Engineer representatives of the consumer appeared before the committee and due hearing was given to them. The case was discussed at length in the previous meeting on dated 21-12-2012. During discussion various factors were taken up and finally the issue that remains to be settled was the surcharge. The judgment of learned Ombudsman dated 09-07-2009 was also gone through at length. The representatives of the consumer could not justify any of the grounds mentioned in their representation dated 08-11-2012.On page 2 of this above representation, the consumer has agreed to deposit the amount of Rs. 5,16,432/- out of deputed amount and has contended that surcharge of Rs. 1,24,874/- being claimed is not payable since the amount paid is as deposit and not against any energy supplied to them by PSPCL. The representatives of the consumer could not bring forth any facts to justify their contention. The amount being billed by the PSPCL is on the basis of regularly billing process. The billed amount was not paid and thus the surcharge is levy able and payable by the consumer. In view of the detailed discussion the representatives of the consumer agreed that there are no such instructions to support their contention and have no other facts to justify their representation. Accordingly, the amount billed by the PSPCL is fully justified and payable by the consumer.

1 Fri 21, Dec 2012  The case came up for hearing before the committee on 04-11-12. Er. Darshan Singh, Dy. CE/DS Circle Kapurthala presented the case before the committee for discussion. Nobody was present on behalf of the consumer. A Fax Message received today from the consumer and placed on record. Due to delay in communication regarding the date of hearing to the consumer, this case is adjourned in the interest of justice to the next meeting. Dy. CE/DS Circle, PSPCL, Kapurthala is directed to ensure that in future the consumer is communicated regarding the date of hearing well in time. He is also directed to inform the consumer for submitting his detailed representation/petition to the Chairman, ZDSC-cum-CE/DS(North), PSPCL, Jalandhar within 7 days hereof and copy of the same to Dy. CE/DS Circle, PSPCL, Kapurthala who will submit his detailed comments on the same within 7days thereafter. Warning Letter may be issued to Additional S.E./DS Division, P.S.P.C.L., Kartarpur to be more careful in future for not intimating the consumer in time regarding the meeting of 04-11-2012.
In the interest of justice, this case is deferred to the next date.
2 Wed 23, Jan 2013  The case came up for hearing before the committee on 04-11-2012 and again on 21-12-2012. Er. Darshan Singh, Dy.CE/DS Circle, Kapurthala presented the case before the committee for discussion. Sh. Parveen Kumar, Deputy Manager and Sh. Balwinder Kumar, Engineer was present before the committee on behalf of Power Grid Corporation India Ltd. Due hearing was given to them. They have sought more time to work out the details and other facts in this behalf and requested that adjournment may kindly be granted to them. The request of the representatives for date has been considered. In the interest of justice, this case is deferred for the next date when the consumer will come with the detail as asked for them.
