5.  ਫੈਸਲਾ Sh.K.D.Parthi, Counsel for the petitioner attended the meeting. This consumer has approached ZDSC for the refund of Rs 939600/- already deposited by him towards cost of Independent feeder. Brief History:- This consumer has got 1558.211 KW Load/1340 KVA CD. He applied for extension of 931.769 KW/ CD 1155 KVA load A&A no: 130/SE, dt: 18.2.10 and deposited the earnest money for Rs.136300/-. Feasibility for this additional load was cleared by CE/Commercial, Patiala vide memo no: 24237 dt: 12.10.11. As per this feasibility clearance, the proposed load was to be released from existing 11 KV Surindra Cycle feeder by augmentation of the conductor (0.672 KM) from 65 mm2 to 95 mm2. The consumer subsequently submitted the test on 2.4.12 by depositing Rs: 1039500/- as service connection charges, but this load is yet to be released because 220 KV S/S Gaunsgarh has not been commissioned so far, which was a condition for release of this load. In the mean time, the consumer submitted an application dt: 17.9.11 requesting to feed his existing load of 1558.211 Load/CD 1340 KVA through an Independent feeder to be erected at his cost. CE/OP(C ), Ludhiana vide memo no:4549 dt: 21.4.11 allowed to erect a new Independent feeder by getting all the charges deposited from the consumer. Accordingly, consumer paid Rs: 939600/- towards the cost of Independent feeder & the feeder was erected & his supply is now running on this feeder. The consumer in his pleadings submitted that Rs 939600/- already deposited by him towards the cost of Independent feeder should be adjusted/ refunded, because he has paid service connection charges for getting extension in load amounting to Rs: 1039500/- which is more than Rs: 939600/-. Observation:- This case was deliberated at length and Committee observed that the feasibility of the consumer is cleared from 11KV surendra cycle feeder after augmentation of conductor from 65square mm to 95square mm for length of 0.792KM. IN the meanwhile the consumer applied for independent 11KV feeder for which the approval was granted by CE/Central on 21.4.2011 with a direction to submit revised feasibility clearance vide memo no 4549 dt. 24.4.2011. But inspite of submitting the revised feasibility clearance, the petitioner was issued a demand notice for Rs.1039500 vide no 5176 dt. 25.11.11 which was deposited vide BA16 No 547/10509 dt. 2.4.2012. Now the consumer has challenged that PSPCL has demanded and charged double payment, i.e. for the entire cost of independent feeder for Rs.9,39,600/- and second on account of SCC. The petitioner requested to accept the highest payment i.e. Rs.10,39,500/- and refund the deposited cost Rs.9,39,600/-. Decision:- After deliberations, the Committee decides that as per the circumstances of the case the independent feeder has been granted to the consumer on his request and according to instructions of PSPCL whenever any consumer requests for independent feeder he has to bear entire cost of feeder. Therefore, the amount charged to the consumer i.e. Rs.9,39,600/- on account of deposit work/cost of independent feeder is justified and hence not refundable. Regarding the amount of demand notice deposited for getting extension in load, Committee observed that the feasibility of the applicant has been cleared from the existing 11KV Surendra Cycle feeder by augmenting its conductor from 65 mm2 to 95 mm2 and demand notice has been issued according to sanctioned proposal whereas now as per present situation the connection is to be released from newly erected 11KV independent feeder by providing 150 mm2 cable for which the petitioner has deposited the full cost and feasibility of petitioner has to be revised and got cleared from F.C.C. again by bringing the facts to its notice. The amount payable by the petitioner as SCC may be determined and recovered as per the instructions contained in Supply Code clause 9.1.2 (C.). The case is disposed off accordingly.

1 . Details of ACD/SCC deposited by consumer in chronological order.
2 . Whether augmentation of conductor has taken place or not as per the conditions imposed, while clearing the extension of load by FCC.
Consumer case in original should be presented to the committee. The case was deferred.
