5.  ਫੈਸਲਾ 1. The petitioner is having MS connection bearing account no MS11/0533 in the name of M/s W.J.Modern Mech. with sanctioned load of 55 KW. 2. The meter of the petitioner was checked by ASE/Enforcement-II vide ECR No 46/873 dated 11.8.2011 and declared defective. The defective meter was changed vide MCO No.86188/1013 dated 25.08.2011. Audit party vide HM No 57 dated 25.9.12 overhauled the account of the petitioner for the period 2/2011 to 9/2011 on the basis of consumption of the same month of previous year. Supplementary Bill of Rs.239255 was issued to the consumer. The consumer challenged the amount and requested CE/Central to consider the case in Zonal DSC. The consumer deposited 20% of disputed amount of Rs.47850/- vide BA16 No.493/933 dt 19.10.12. Proceedings ZDSC heard this case on 16.11.12 and finally on 3.12.12 when the case was closed after passing speaking order. The petitioner submitted his petition in which he stated that his connection was checked by Enforcement vide ECR No.46/873 dated 11.08.2011 and reported that there was no display on the meter. This checking by the Enforcement was done against the letter given by the concerned Division when the meter reader has seen that there was no display on the meter while taking the reading. This meter was sealed packed and sent to ME Lab where the KWH reading by 0304987 and KVAH reading was 0326798 which was clearly visible and also the MDI was 324.736 KVA. He further stated that he took this premises on rent from 1.04.2011 and shifted machinery slowly and slowly which caused in a low consumption of 1421 and 1456 for the month of April and May 2011. After completing the setting of machinery and labour, the consumption for the period 30.06.2011 to 30.07.2011 was 6700 units which means that the meter was absolutely OK at that period. The consumption for the period 30.7.11 to 30.8.11 was just by 525 units due to break down of the machinery. He stated that the overhauling of the account was illegal and unfair. PO in his reply has stated that as per report of Enforcement, Meter was defective and it was found that reading/pulse was not displayed at the time of checking and the reading could not be taken due to the defective meter. The meter was checked in ME Lab. Vide Store Challan No.111104/33966 dated 9.11.11. As per Store challan the meter is defective/burnt and final reading of the meter was KWH 0304987.3, KVAH 0320798.0 and KDI 34.736. The meter was checked in the presence of the consumer‘s representative who has appended his signatures on Store challan. Hence the meter was reported to be defective in 2/2011 and the consumption from 2/2011 till the change of meter i.e. upto 9/2011 is very less as compared to the previous months consumption as well as corresponding month of the previous year 2010 and the basis of this ,the account has been correctly overhauled by Audit The committee deliberated the case and observed that consumer has taken this premises on rent from 1.04.2011 and contention of the consumer seems to be genuine as stated in his petition that he shifted his machinery slowly and slowly which caused in a low consumption thereafter. Conclusion. It was decided by the committee the account of the consumer may be overhauled for the period 8/2011 to the change of meter and fresh notice be issued accordingly. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.

1 Fri 16, Nov 2012  Mr. Kailash Kumar, tenant appeared before the committee and submitted rent deed. PO was directed to obtain petition from the consumer and give point wise reply on the petition and submit in the next ZDSC meeting. Case was deferred.
