5.  ਫੈਸਲਾ 1. The petitioner is having MS connection bearing account no JM17/80 in the name Shirimati Agya Devi with sanctioned load of 75.19KW. 2. The consumer challenged the meter by depositing Rs. 1250/- vide BA 16 No.477/7980 Dated 5.09.2012 3. The meter of the consumer was checked by Sr. XEN Enforcement-3 vide ECR no 22/3286 dated 5.09.12 and accuracy of the meter was within limit. DDL was also taken. 4. The meter was replaced vide MCO no W21/M/12/126979/3320 dated 5.09.12 effected on 12.09.12. The meter was tested in ME Lab vide store challan no 120920/53817 dated 25.10.12, the results of meter was within limit. The final reading of the meter was 611726.71 KWH whereas last reading of the meter recorded in the billing cycle 10/2012 was 567436. At the time of checking by Sr.Xen Enforcement on dt 5.9.12, the reading was recorded as 610665.2. The bill for the month of 10/2012 (difference of 44291 units+ 2219 unit of new meter) amounting to Rs. 307030/- was raised to the consumer which he challenged. 5. The consumer deposited 20% of the disputed amount of Rs 61406/- vide receipt No.9808718 dated 30.10.12. 6. The consumer was not satisfied with the amount raised on him and requested the office of CE/DS Central Zone Ludhiana for review of his case in ZDSC. On the request of the consumer, the case was registered for hearing vide CE/DS Central memo no 11246/47 dated 30.10.2012. The consumer deposited 20% of disputed amount vide receipt No.9808718 dated 30.10.12 forRs 61406/-. ZDSC heard this case on 16.11.12, 3.12.2012, 3.1.13 and finally decided on dated 2.2.2013 when the case was closed for passing speaking order. The petitioner submitted his detailed petition in which he contested that the amount charged to him is not correct. He stated that the reading of the meter on 28.08.2012 was 567436 and on 29.08.2012 readings were 609513. He assumed that his meter had been jumped. The bill for the month of 9/2012 issued to him is result of jumping of meter reading. Petitioner Arguments: As per petition Observation of the committee: - After going through the petition and record, Committee observed that although as per report of ME lab, the working of meter is found to be within limits but the final reading on meter as noticed from DDL print outs has considerably gone back for example the reading recorded in the month of 8/2012 was 567436KWH whereas ASE/Enforcement recorded reading on 5.9.2012 as 610665KWH and at the time of final removing of meter on dt. 12.9.12 the reading was 611726KWH. At the time of DDL print outs the reading is printed to be 531799KWH and the KVAH reading is 776695.90 which clearly indicates that the KWH reading is quite less than the reading recorded by ASE/Enforcement on 5.9.2012. The noting of both the readings is based on reliable sources and cannot be doubted which clearly indicates that meter has gone defective and hence not reliable. Decision of the committee: - So as per the observation of the Committee, it was unanimously decided that the account of the consumer may be overhauled from January 2012 to change of meter on the basis of recorded consumption for the year 2010. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.
