5.  ਫੈਸਲਾ Brief History: The petitioner is having LS connection bearing account no SL 01/142 in the name Menka Industries with sanctioned load of 2495KW& CD 2495KVA. The consumer was charged Rs.553181/- as services charges + variable charges by audit party vide HM No spl-8 dt.26.7.12. The consumer instead of depositing the amount requested CE/DS to consider his case for ZDSC which was allowed and registered vide Memo No 11962 dt. 22.11.12. The consumer deposited 20% Rs.110637 vide BA 16 No.237/53 dt 30.11.12. ZDSC heard this case on 3.12.12, 3.1.13, 2.2.13, 22.2.13 and finally on dated 8.3.2013 when the case was closed for passing speaking order. The petitioner submitted his detailed petition on dt 1.2.13 in which he contested that as per clause 9.1.1 (i) of supply code and related matters regulation 2007, variable charges are recoverable for load upto 500 KW/500 KVA his load released is more than 500 KW/500 KVA these charges are not recoverable from him. The PO in his reply stated that the amount charged to the consumer is as per CC No.68/2008 which is correct. Observation of the committee: - The Committee has gone through the history of case, petition submitted by consumer and reply of PO and observed that although the instructions contained in the Supply Code-2007 are silent about variable charges in case of new connections, where load or demand exceeds 500KW/500KVA, but the rate of variable charges has been M/s Menka Industries A/c No. LS-142 incorporated in Column No. 5 (II) of CC No. 68/2008 issued on 17.12.2008 and the standard cost data annexed to this circular includes that the variable charges are payable on case of connections with load 500 KW and above. Therefore the committee observes that standard cost data was duly approved by PSERC as per Regulation 10 of Electricity Supply Code & related matters regulation-2007 and thereafter CC No. 68/08 dated 17.12.08 was issued accordingly. The ZDSC observed that the amount charged to the consumer is as per cost data annexure-A read with CC No.68/2008 at sr no.5 (h) is in order. Decision of the committee: - Keeping in view the petition, oral discussion, reply submitted by PO, it was unanimously decided that the amount charged to the consumer is correct and recoverable. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.
