5.  ਫੈਸਲਾ The petitioner is having a MS connection having SL of 59.710KW. The connection was released on 27.9.2009. The connection of the consumer was checked by ASE/Enforcement-1, Ludhiana Vide ECR No.19/403 dated 5.9.2012 and reported that the meter was running slow by 47.18%. As such the DDL of meter was done and yellow phase of the meter was found dead. On the basis of this checking, the account of the petitioner was overhauled and was charged for Rs. 372712/-on account of slowness of the meter from 1/10 to 8/12. The petitioner being not satisfied with the charged amount represented before CE/DS Central and requested to register the case for ZDSC. The case was heard in ZDSC meeting dated 3.1.2013 and finally decided on dated 2.2.2013. Sh. Sanjeev Sood authorized representative of the consumer attended the meeting and pleaded that the period of overhauling which is from the date of connection to the date of replacement of meter should be restricted to six months as per the instructions of PSPCL. The Committee explained to the consumer that it not a case of defective meter but it is a case of wrong metering from the date of release of connection as authenticated in the DDL report of Enforcement Wing which was also shown to the consumer. The Committee after going through DDL report, consumption data and ECR report observed that according to the statement of PO the yellow phase of the meter was found to be dead due to loose connections since date of connection i.e. 1.10.10 which was authenticated from the report of DDL also. So keeping in view the date confirmed from DDL report and error factor calculated on the basis of checking of meter with ERS meter by ASE/Enforcement-1 Ludhiana, the Committee decides that the amount charged is correct and hence recoverable. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL.
