5.  ਫੈਸਲਾ The consumer is having LS connection with SL of 2499KW and 2499CD. He is having sanctioned PLEC load of 1800 KW and restricted load of 100 KW. The dispute pertains to calculation of PLEC charges from the period 1.4.2010 to 10.4.2012. As per version of the consumer, PLEC charges calculation should have been done by reducing restricted load from the permitted load for the above said period by CBC Cell, Ludhiana. However, after the month of 4/2012 CBC Cell is now rightly calculating the PLEC charges by reducing the restricted load of 100 KW from the permitted load i.e. 1800 KW, CBC Cell should have followed the same pattern of calculation as per latest instructions of PSPCL for the disputed period i.e. 1.4.2010 to 10.4.2012. The consumer represented the matter before CE/DS and requested to consider and register the case for ZDSC. The case was registered in ZDSC vide Memo no. 12461 dt. 11.12.12. The case was earlier heard in ZDSC meeting dated 3.1.13 and finally decided in meeting dated 2.2.13. Committee deliberated the issue. After going through the petition and other documents the Committee observed that the claim of petitioner regarding adjustment of 100KW load allowed during Peak Load Hrs from the permitted peak load exemption is justified and hence allowed. However, their claim that the 100KW load allowed during peak load hrs to be adjusted / deducted from higher slab is not justified as the consumer has to first avail its permanent exemption allowed during peak load hrs and then utilize the permitted load during peak load hrs. Therefore the calculation made by CBC by deducting the 100KW load from the lower slab is alright and same procedure of calculation may be carried forward from10.4.12 onwards.
