5.  ਫੈਸਲਾ Sh.Narinder Handa (Owner) attended the meeting. This consumer was issued bill for RS: 253735/- for the month of 8/12 for 45127 units. Consumer challenged the meter & the same was checked by ASE/Enforcement on dt: 21.7.12. As per this checking report, the pulse & the display of the meter were found stopped. The meter was changed & taken to ME Lab on dt: 11.9.12. As per ME Lab report, the results of the meter were found within permissible limits. The petitioner being not satisfied with the report of ME lab, requested CE/DS Central to consider his case for ZDSC which was accepted vide memo no 12193 dt. 30.11.12 subject to deposit of 20% of the disputed amount. The case was heard in ZDSC meeting dated 3.1.13 and finally decided in the meeting held on 2.2.13. The petitioner in his petition stated that during 7/2012 it was observed that meter jumped on dated 7.7.12 as they were maintaining record of consumption on daily basis. He immediately challenged the meter. He further stated that they have not changed their nature of work and the average consumption is between 3000 to 4000 units per month. He requested to give him justice as the unit charged in their bill was only due to jumping of meter. The PO in reply to the petition of the petitioner submitted that as per the consumption data maintained by the petitioner, he is consuming 100 to 200 units daily and if the consumption data of last three years is considered the average consumption is between 3000 to 7000 units per month and such excessive consumption of 45127 units is never noticed in the data. The Committee observed that there is no doubt that the consumption recorded in billing cycle of August-2012 i.e. 45127 units is higher as compared to the average consumption recorded during the previous year’s i.e. 2010-11 and 2011-12, but at the same time while testing the meter in ME lab, the working was found within limits. Committee also observed that the consumption recorded on meter has fallen w.e.f. April-2011 as compared to corresponding month of previous year’s. Therefore, in view of the very forceful appeal of petitioner as well as the low consumption recorded on meter during one year prior to recording 45127 units the erratic behavior of the meter can’t be ruled out approximately one year prior to date of detection. In view of the above, Committee decided that in order to be fair to petitioner and in view of low recording of consumption during last one year the meter may be declared as erratic and petitioner may be charged on basis of average taking healthy base period from 1.4.2010 to 31.3.2011 and defective period from 1.9.2011 to 31.8.2012. The balance amount recoverable / refundable, be recovered / refunded from / to the petitioner alongwith interest / surcharge as per instructions of PSPCL. Fresh notice be raised in accordance to the above decision.
