5.  ਫੈਸਲਾ The case has been discussed at length in the previous meetings as well, the consumer wanted to draw forth more material facts for the reconsideration of his case in his written petition dated 17.5.13 and the second petition submitted today. He has not been able to produce any cogent and reliable evidence or any circumstances under which he can justify his retracting from his earlier undertaking which the department accepted and even the consumer has, by his own conduct, accepted the same by depositing several installments. This case has been remanded by the Forum to the ZDSC for reconsideration. It is a simple case and the core question is that the amount being charged from the consumer is on account of wrong M.F. There is no dispute and the amount is being charged in order to compensate the losses of PSPCL on a/c of wrong M.F. and nothing else. The consumer has further submitted that he does not agree with the checking carried on 10-09-2011 by MMTS placed in the file at Page-18, 19 and 20 which clearly confirms his presence and confirmation duly signed by the consumer on pages 19 and 20 of the said report. This report conclusively proves the various facts of the case and finally that the amount as determined by the ZDSC today is simply to compensate the losses of the PSPCL which occurred due to the facts and circumstances mentioned in the said report as well. It is further established and made clear that in this case there was no defect in the metering equipment i.e. meter or CT/PT unit. Only wrong M.F. was applied in this case as per checking reports. Thus the claim of the consumer stands frustrated. There is, thus, no circumstance under which he is entitled to retract from his undertaking and claim any relief in not paying the amount as mentioned above. The case is decided accordingly and the consumer be charged as per his already given undertaking to the Hon\'ble CMD in accordance with PSPCL rules.

Sarabjit Singh Director of M/s Varindra Tools Pvt. Ltd. along with Mr. Mayank Malhotra Advocate appeared before the committee. Sh. Sarabjit Singh Director of the consumer has submitted his petition in writing today, which has been placed on record and a copy of this petition has been given to Dy.CE/DS Circle, Jalandhar. Dy.CE/DS Circle, Jalandhar has directed to offer his comments within 7 days to the ZDSC with a copy to the consumer who may file his rejoinder, if any, within 7 days thereafter before the ZDSC for final consideration on the next date. The case is adjourned to the next meeting.
