5.  ਫੈਸਲਾ This case has again been taken up and discussed in detail. The consumer was directed on the previous occasion to produce the documentary evidences showing factum that his factory was closed. He has failed to produce any document, whatsoever, to prove his case. Dy.CE/DS Circle, Jalandhar has intimated vide his letter No. 21641/43 dated 26-08-2013 that the case pending with the Circle Level DSC has been decided on 29-07-2013 and minutes of meeting thereof are already placed in the case file of this consumer. The meter reading of the consumer taken by Sh. Prem Pal JE on 29-04-2013 on the application of the consumer is 0593158 whereas the reading in the \'clumju\' (Meter Reading Blank) taken by the Meter Reader JE-I on 02-05-2013 is 0552525 which shows that the reading taken by the Meter Reader JE-I is wrong. The DDL of the meter for 70 days covering the month of May, June and July, 2013 has been worked out by Dy.CE/DS Circle, Jalandhar as 1323 units for 05/2013, 1823 units for 06/2013 and 1298 units for 07/2013 which again proves that the reading brought by the then Meter Reader JE-I for the above months are incorrect. The consumer has pleaded that although major production of his factory was stopped due to commercial reason, however, some sample manufacturing work and office consumption was going on and one gate of the factory remained open, therefore, he has stated that \"0\" consumption reported by the Meter Reader JE-I continuously for two years i.e. from 02/2011 & 03/2013 (disputed period) was wrong. He has also submitted the copies of Vat and production data attested by the C.A. which shows the production was nil for almost whole of the period and only small consumption of office or small manufacturing was going on. The committee deliberated the whole case very deeply and observed that there is no exact calculation possible to calculate actual month wise consumption for the disputed period. Further, the committee observed that during the year 2010, the minimum consumption of the consumer was 609 units for the month of 12/2010 and decided that this consumption of 609 units per month is quite fair, be assumed as basis for the disputed period in order to give justice to the consumer. Therefore, the case is decided accordingly i.e. the consumption for 5/13, 6/13 and 7/13 may be taken as per DDL as mentioned above and 609 units per month for 1/2011 and from 3/2011 to 3/2013 and rest of the consumption out of total 35577 units may be taken as consumption for the month of 4/13 and account of the consumer may be overhauled as per instructions of PSPCL. The interest on disputed amount may be levied as per instructions of PSPCL. Before concluding the ZDSC observed that reckless intentional negligence on the part of the then Meter Reader JE-I and RA concerned who obviously neglected to look to the working of this account and kept silent for about 2 years and did not investigate the cause of nil consumption against the instructions of the PSPCL. Their conduct in this behalf needs probe and disciplinary action may be initiated against them by Dy.CE/DS Circle, Jalandhar.

1 Thu 29, Aug 2013  The case came up for hearing before the committee on 26-07-2013. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Pritam Singh Sapra son of the consumer Smt. Ram Piari appeared before the committee in person. The consumer's representative prays that an opportunity may be given to him finally to submit his detailed representation on this behalf which he has not submitted. In the interest of justice the case is adjourned to the next date with the directions that the consumer shall submit his detailed representation, if any, within 7 days to Dy.CE/DS Circle, Jalandhar who will submit his detailed comments on it within the 7 days. He is directed to get the DDL from MMTS for the period from 3/2011 to 6/2013 stating therein the monthly consumption, KWH, KVAH, power factor and monthly average and present status of the meter along with his detailed comments. Thus the case be put in the next meeting.
2 Wed 25, Sep 2013  This case again came up on 29-08-2013 in the meeting. Er. Gopal Sharma, Dy. CE.DS Circle, Jalandhar presented the case before the committee. Sh. Pritam Singh Sapra son of the consumer Smt. Ram Piari appeared before the committee in person. He has submitted his representation in this case today which has been placed on record and a copy thereof has been supplied to Dy. CE/DS Circle, Jalandhar. Dy. CE/DS Circle, Jalandhar is directed to give his comments in detail along with reasons for incorrect readings for 03/2013 to 06/2013. The consumer is also directed to submit his complete documentary evidence duly verified by the CA in support of his ascertains in the representation submitted by him today. The consumer has mentioned in his representation that he is enclosing 8 No. documents which have not been provided by him. He is directed to provide a copy of all the documents within 7 days with a copy to Dy.CE/DS Circle, Jalanhdar. The case is adjourned to the next date.
The consumer is also directed to supply a copy of production data along with sales data and Vat data for the period 03/2011 to 05/2013 certified by the CA. Dy. CE DS Jalandhar is directed that reading record of the concerned official may be brought in the next meeting.
