5.  ਫੈਸਲਾ This is a case of MMC before release of connection from 1.01.2014 & 10.2.14. The case was heard on 10.4.14 ,8.05.14, 28.05.14 & finally decided on 06.06.14 as under: After hearing the consumer & PO officer Addl.SE/Op Mohali who was present in the committee at that time, also heard the case. After checking the report deeply which was sent by the Protection wing , was this discussed and it was seen that the firm is also at fault because the reply of information required vide letter written by Sr. Xen/ Protection No.625 dated 09.12.3 was received in Protection divn. 6.01.14. If the consumer has made the compliance of letter earlier, the testing work could have also been done earlier. The firm replied the letter after 28 days. If the firm has replied with in seven days then delay of 21 days can be avoided. The delay of 21 days is on the part of firm from the date of receipt of letter/ apply after giving the requisite relief. After listening the representative of the consumer& checking the record Presenting by the PO it has been noticed that in this case although protection divn is responsible for delay. But the record which was demanded by the applicant vide No 625 dated 09.12.13 was given by the firm on 06.01.14. So the firm has given the reply after 28 days. It has been decided by the committee that delay of 28 days by the firm & after giving the benefit of seven days further, firm is here by responsible for delay of 21 days and the firm be charged MMC for 21 days. The amount be recovered from the firm including surcharge/ interest has per the instructions of PSPCL. Disciplinarily action be taken against those officers of protection divn, who are responsible for delay.
