5.  ਫੈਸਲਾ Brief History This is 66 KV cluster connection having 2 no. 11 KV members namely M/s Tharaj Casting and M/s Manglum Recycleing Ltd. This 66 KV connection was checked by ASE/MMTS-3, Ludhiana vide ECR No.31/2199 dated 29.7.13 and observed that the CT of yellow phase was defective. From July-2013, the sum total of consumption of 11 KV members was more than 66 KV consumption and therefore, ASE/CBC ,Ludhiana enhanced consumption by 1.5 times recorded on 66 KV meter from July,2013 onwards. Subsequently, connection was checked again vide ECR no.35/2351 on 20.1.14 jointly by AE operation unit no.2, AEE protection-II and ASE/MMTS-III and found that on the terminals of ABT meter the yellow phase terminal wire was found carbonized and the same was set right. The bill for Feb.2014 was again issued by enhancing consumption recorded on 66 KV meter by 1.5 times. The total consumption of 11 KV meter was 6,61,818 units while 66 KV consumption was 5,51,333 units which was enhanced by 1.5 times and thus bill for 827000 units was issued. Proceedings The consumer in his petition pleaded that as per the report of AE/Operation and AEE protection the defective wire was set right. On 20.1.14 and from 21.1.14 to 29.1.14 working of the meter was correct and also working was OK from 13.2.14 to 15.2.14. Accordingly, the consumer requested that he should be given benefit for this period when all the 3 phases of the meter were contributing. Observation Committee observed that from July,2013 to Feb,2014, the 66 KV meter of the consumer was not recording correct energy and ASE/CBC correctly enhanced the consumption by 50% recorded on 66 KV meter. During the previous meeting, PO was directed to get the report of ASE/MMTS regarding correctness of the working of 66 KV meter from 20.1.14 to 29.1.14 and from 13.2.14 to 15.2.14 to arrive at the period when the meter remained defective. PO informed the committee that he discussed the matter with ASE/EA & MMTS-3 and directed to supply the DDL print out of 66 KV meter as well as 11 KV meter installed as cluster members. ASE/MMTS-III informed that they were not taking the DDL print out to cluster members but as directed by the committee ASE/MMTS-III took the DDL print out of both the cluster members having connections bearing account no.LS 314 in the name of M/s Manglum Recycling Ltd. And account no. LS 218 in the name of Tharaj Casting and submitted the report vide memo no.2656 dated 25.4.14 to ASE,Estate Division, Ludhiana. He informed that exact consumption from 20.1.14 to 29.1.14 was not possible to calculate as per the DDL print out and intimated that the average one day consumption of 11 KV members comes to 23423.28 units per day. ASE/MMTS-III also intimated that as per the DDL print out the consumption from 20.1.14 to 29.1.14 of 66 KV meter comes to 1,98,930 KWH which was not found to be correct in view of the consumption recorded on 11 KV cluster members. Decision After detailed deliberation, committee unanimously decided to overhaul the consumption of the bill under dispute i.e. from 16.1.14 to 15.2.14 by taking the average consumption recorded on 11 KV cluster members which is 23423.28 units per day and if converted to 30 days, it comes to 7,02,698.40 units. Normally to arrive at 66 KV consumption for billing purpose, 3% transmission losses are required to be added to this consumption. But the consumer Sh.Naveen Kumar informed the committee that from the consumption pattern available from Jan.2012 onwards the transformation losses are less than 1% of the consumption recorded on 11 KV cluster members. The committee studied the same and agreed with the view of the consumer that transformation losses were actually in the range of 1% of the consumption recorded on 11 KV side. Therefore, it was unanimously decided that 1% transformation losses should be added to the consumption of 7,02,698.4 units. The bill of the consumer for the month of Feb.2014 should be revised from 827000 to 709725.8 units as explained above. The consumer also agreed with the above decision. Amount should be recalculated and the consumer should be informed accordingly. It was further decided that the interest/surcharge may be refunded/charged as per rules and regulations of PSPCL.
