5.  ਫੈਸਲਾ Brief History This consumer had approached ZDSC for the refund of Rs.939600/-already deposited by him towards cost of independent feeder. This consumer has got 1558.211 KW Load/1340 KVA CD. He applied for extension of 931.769 KW/ CD 1155 KVA load vide requisition no: 130/SE, dt: 18.2.11. Feasibility for this additional load was cleared by CE/Commercial, Patiala vide memo no: 24237 dt: 12.10.11. As per this feasibility clearance, the proposed load was to be released from existing 11 KV Surindra Cycle feeder by augmentation of the conductor (0.672 KM) from 65 mm2 to 95 mm2. The consumer subsequently submitted the test report on 2.4.12 by depositing Rs: 1039500/- as service connection charges. The extension in load was released on dt.22.03.2013. In the meantime, the consumer submitted an application dt: 17.9.11 requesting to feed his existing load of 1558.211 Load/CD 1340 KVA through an Independent feeder to be erected at his cost. CE/OP(C), Ludhiana vide memo no: 4549 dt: 21.4.11 allowed to erect a new Independent feeder by getting all the charges deposited from the consumer. Accordingly, consumer paid Rs: 939600/- towards the cost of Independent feeder & the feeder was erected & his supply is now running on this feeder. The consumer in his pleadings submitted that Rs 939600/- deposited by him towards the cost of Independent feeder should be adjusted/ refunded, because he has paid service connection charges for getting extension in load amounting to Rs: 1039500/- M/s Surindera Cycles Pvt. Ltd. Account no: FP-55/0204 which is more than Rs: 939600/-. The same issue was discussed in ZDSC meeting dated 02.02.2013 against case no 411/2012. It was decided that the independent feeder has been granted to the consumer on his request and according to the instructions of PSPCL whenever any consumer wants supply on independent feeder, he has to bear entire cost of feeder. Therefore, the amount charged to the consumer i.e. Rs.939600/- on account of deposit work/cost of independent feeder is justified and hence not refundable. Since a separate feeder has already been erected for this consumer, therefore, the feasibility for additional load for 931.789KW/1155KVA should be got prepared from new independent feeder. This condition was also imposed in the letter issued by CE/Op., (C), Ludhiana in his memo no. 4529 dt.21.04.2011 vide which the consumer was allowed independent feeder. After that, the charges recoverable from the consumer may be re-worked out as per Elecy. Supply regulation 9.1.2(c) read along with CC 25/2012. The consumer made appeal against this decision in CGRF, Patiala. On dt.19.11.2013, the Forum ordered to register this case for hearing in ZDSC. The case of the consumer was registered for hearing in ZDSC vide memo no.11348 dt.30.12.2013. Now, the consumer demands refund of Rs.1039500/- deposited as service connection charges. Proceedings Sh.K.D.Parthi, Authorized representative of the consumer appeared before the committee in the meeting dated 24.1.2014. P.O. presented the comments of ASE/Op., Focal Point Divn. on the petition of the consumer for further study and a copy of the comments was handed over to Sh.K.D. Parthi, representative of the consumer. In the meeting dated 22.2.14, Committee directed the P.O to submit the detailed statement showing the service connection charges charged to the consumer for extension of load viz-a-viz the amount deposited by the consumer at the time of various extensions in the chronological order keeping in view CC 25/2014 in the next meeting, which was presented by the PO in the meeting dated 7.3.2014. The same was studied by the Committee. The committee directed the P.O. to study the case thoroughly and further asked to clarify in the next meeting that whether this case falls under the purview of CC-25/2012 or under Electricity supply code regulation Clause 9.1.2(c). In the meeting dated 21.03.2014 P.O. clarified to the committee that this case is not covered in CC-25/2012 as its date of issue is 22.08.2012 where as consumer has submitted his test report on 02.04.2012. So in this case only Electricity supply code regulation Clause 9.1.2(c) is applicable. The committee discussed the case in detail and directed the P.O. to re-submit the calculation sheet showing charges to be recovered from the consumer on pro-rata basis in the light of Electricity Supply code regulation Clause 9.1.2(c) in the next meeting. In today’s meeting, P.O. presented the calculation sheet prepared by ASE/Focal point division Ludhiana vide his office memo no 2463 dated 31.3.2014, showing charges to be recovered from the consumer on Pro-rata basis taking into account the proportionate cost of HT main and proportionate cost of feeding sub-station (by taking the value of 20MVA power T/F only) in the light of Electricity Supply code regulation Clause 9.1.2(c). P.O. also pointed out that these charges are not firm as no prescribed formula is approved by the corporation. P.O. also presented a copy of memo no 542 /SS(D)-10/S dated 30.4.2012 written from the office of Dy.CE/SS(D), PSPCL Patiala to Dy.CE/Sales-1, PSPCL Patiala regarding Electricity supply code and related matters Regulations 2007-calculation of 220/132/66/33 KV Sub-station Standard Cost data for the year 2011-12. Observations The committee studied the above statement and documents. The committee observed that the proportionate cost of HT Main per KVA should be calculated by taking CD as 2495KVA instead of 1340KVA as such the cost of HT main per KVA comes to Rs.377/-instead of Rs.701/- as calculated earlier. Accordingly the proportionate cost of HT Main and proportionate cost of feeding S/Stn. comes to 377+577=954 per KVA, as the cost of the feeding sub-station is not specified by the corporation.
