5.  ਫੈਸਲਾ The consumer is having a LS connection with sanctioned load as 598.07 KW. The consumer was found violating peak load restriction from 1.11.2013 to 28.11.2013 as per DDL report of Addl.SE, MMTS-2, Ludhiana dated 2.1.2014 and was charged for Rs. 447346/-. The case was deferred in the previous meeting held on 1.8.2014 in which P.O. was directed to comment on the petition of the consumer. As per the directions of the Committee, P.O. submitted the comments on the petition of the consumer. In today`s meeting Sh. Surinder Kumar and Sh. Sukhminder Singh appeared before the meeting and pleaded that they have not violated regulator measures of PSPCL deliberately and the mistake of observing PLHR with wrong timings is not intentional as such the demand raised is liable to be quashed on the interest of natural justice. Petitioner pleaded that amount calculated was wrong and calculation of load was also wrong. P O informed that calculation and load was got re-checked and found correct. Petitioner also pleaded that amount charged was at double rate. P O informed that the Petitioner was defaulted in previous block and amount charged was correct. After going through the petition, comments given by the PO and DDL, it was decided by the Committee that the amount charged is ok and recoverable. Committee further decides that the balance amount recoverable/refundable, if any, be recovered/refunded from/to the consumer along-with interest/surcharge as per instructions of PSPCL.
