5.  ਫੈਸਲਾ History The petitioner is having 66 KV cluster, comprising of 2 members getting 11 KV supply having account no. LS 218 in the name of M/s Tharaj Casting Ltd. & A/c no. LS 218 in the name of M/s Manglam Recycling This consumer was charged Rs.2657309/- as per the RBS no. 36/2014 dt. 06.05.14 issued by ASE/CBC. As per RBS, accounts of the consumer were overhauled from Jan.2013 to June 2013 in view of ASE MMTS III, memo no.2957 dated 29.4.14 vide which he had given speaking orders that there was erratic behavior of 66KV meter from 17.9.12 to 16.7.13. Therefore, the sum total of consumption of both the cluster members recorded at 11 KV was enhanced by 3% (Transformation losses). Proceedings Consumer submitted the detailed petition and parawise reply was also submitted by PO which was handed over to the petitioner’s representative during the previous meeting. The P.R.(Petitioner’s representative) again submitted the re-joinder on which para wise reply was also submitted by the PO. In his petition, the PR has pleaded that enhancing the combined consumption of 11 KV meter by 3% is not in order because it is on record that transformation losses are less than 1%. The PR also pleaded that 66 KV meter cannot be said to be defective up to 4/2013 on the basis of information/data compiled by the MMTS/CBC. In the rejoinder submitted by the P.R. he has pleaded that transformation losses are between 0.5 to 0.7% during the period 12/12 to 1/12 and he further pleaded that adding 3% on the combined consumption of 11 KV meters is not justified. The PO in his written reply has mentioned that as per ASE,MMTS –III letter no. 2957 dated 29.4.14 and as per energy audit report from 17.9.12 to 16.7.13 the difference in 66KV and 11 KV supply consumption is 786689 units. It is also on record that yellow phase CT was not contributing from 16.7.13 because it was carbonized and ASE/CBC has already enhanced the consumption by 1.5 time from the date of this defect. But the erratic behavior of the M/s Manglam Recycling Ltd. A/c No:W11 EST1/0314(LS) 66KV said meter was earlier not in notice. Therefore, ASE/CBC has correctly, overhauled the accounts from Jan.2013 to June.2013. Observations Committee deliberated the case, studied the consumption pattern of both the cluster members and their consumption at 11 KV from 2008 onwards along with 66KV consumption recorded which was being taken for preparing the bill of the consumer. While going through the consumption pattern of 11 KV and 66 KV consumption, it was observed that behavior of 66 KV meter was erratic for quite some time for example in April,2009 66KV recorded consumption was 335400 while total of 11 KV consumption was 392152 which was 116.92% of 66 KV consumption. Similarly in Jan.2011, the 11 KV consumption was more than 66 KV consumption by 133.61%. In December,2011, it was 113.49% in May,2013 it was 109.90% in June,2013 it was 109.16%, which confirms the erratic behavior of 66 KV meter. Decision The Committee while going through the data submitted by the PO, oral and written arguments of the petitioner’s representative, unanimously decided that the average of transformation loses from April to July,2014 were 2.15%. Therefore, it was unanimously decided that the accounts of the consumer may be overhauled from Jan.2013 to June 2013 by enhancing consumption by 2.15%. Revised notice be issued to the consumer. Committee further decides that the balance amount recoverable/refundable, if any, be recovered/refunded from/to the consumer along-with interest/surcharge as per instructions of PSPCL.

1 Fri 04, Jul 2014  In the previous meeting consumer had submitted the petition. Parawise reply to the petition was submitted by PO to all the committee members and a copy of the same was also given to the petitioner’s counsel.
The counsel for the petitioner requested that he wanted to give rejoinder to the petition already submitted. The same was allowed by the committee. Case was deferred.
However, PO was directed to submit the consumption data since the date of release of cluster substation i.e. 66 KV readings/consumption and 11KV readings/consumption of both the 11 KV members.
