5.  ਫੈਸਲਾ History This is MS category consumer. This consumer was charged Rs.437228/- as per half margin no.24 dated 24.6.14 issued by Audit Party. As per this half margin, this connection was released vide SCO no.158720/04690 dated 26.3.13. In December,2013, the meter of the consumer was burnt and it was changed vide MCO no.182319/07411 dated 30.12.13. The meter was taken to ME Lab vide store challan no.83 dated 8.1.14. As per ME Lab report the meter was burnt and the reading was not visible. Its DDL also could not be taken on AC/DC mode. Since the consumption pattern of the consumer was not available therefore, the audit party overhauled the accounts by taking actual recorded consumption after the change of meter. Therefore, from 30.12.13 to 18.6.14, the new meter recorded consumption of 43,438 units for 171 days, which means average consumption of 254 units per day. Audit party overhauled the accounts from the date of connection i.e.26.3.13 to the date of MCO i.e.31.12.13.(280 days @ 254 units per day). Proceedings Consumer submitted his detailed petition through his counsel which was replied by PO. The main points taken by the petitioner was that after getting the connection in 3/2013 his manufacturing work could not start due to financial constraints and after getting the bank limit sanctioned in 9/13 most of the machinery was purchased and the actual production was started from 9/13 onwards. The consumer also submitted registration certificate with Punjab Vat Act.2005 issued in 2013. The consumer pleaded that it was the responsibility of the concerned official to take reading of the meter from 4/13 and ensure issue of first bill within 2-3 months from the date of release of connection. Had the readings been taken regularly, that could have become the base for overhauling the accounts if required. The PO in his reply submitted that the master file of this case was sent on 4.12.13 and the first bill issued to the consumer was on MMC basis. The PO in his reply also intimated that consumer could not produce any production data regarding Sh.Deepak Abrol A/c no.MS 02/1979 starting his production in 9/2013 and therefore, average charged by the audit party by taking the future base of correct meter is as per instructions of PSPCL. Observation Committee deliberated the case, studied the petition submitted by the consumer and its reply given by the PO and reached to the unanimous conclusion that after the release of MS connection on 26.3.13, it was the responsibility of concerned officials of PSPCL to issue first bill to the consumer within 2 to 3 months. But ASE/Estate Division in his written reply himself admitted that the master file for first billing of the consumer was started on 4.12.13 i.e. approximately 8.1/2 months, after the release of connection. Had the bill of this consumer been issued in time there would not have been any dispute. Taking the serious view of negligence on the part of officer and officials of the Estate Divn., it was decided to issue charge sheets to the concerned Consumer Clerk, JE (recording the reading), RA and AEE(C) who were responsible for not issuing the first bill to the consumer. Decision After detailed deliberation, committee unanimously decided that the amount charged to the consumer was correct and recoverable as there was no other alternative available except to charge the average based on future consumption. Committee further decides that the balance amount recoverable/refundable, if any, be recovered/refunded from/to the consumer along-with interest/surcharge as per instructions of PSPCL. The consumer should be informed accordingly.
