5.  ਫੈਸਲਾ This case, again, came up for hearing before the committee on 26-09-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. S.K. Vatta on behalf of the consumer appeared before the committee and due hearing was given to him. DECISION: The case has been deliberated at length and it was observed by the Committee that for the month of 01/2013 the consumption of the consumer suddenly increased to 377282 units, whereas before 01/2013 the consumption was less than 4000 units from the year 01/2011 and the meter was changed on 27-04-2013. It was also observed that after changing of meter, again the consumption is between less than 1500 units upto 25-01-2014 when PDCO was affected. On examining the report submitted by Enforcement on his checking dated 12-02-2013 he has mentioned that there was no motive load in the premises and premises was used for godown purpose and only light load was there.Additional SE/Enforcement-II, Jalandhar vide letter No. 201 dated 02-09-2014 addressed to Dy.CE/DS Circle, Jalandhar has clarified that the DDL done on dated 12-02-2013 but when CMRI was checked for meter 0091427 it was not there in the CMRI and no data down load was available in the CMRI and meter was found OK in the test lab. The Committee deliberated and decided that for the month of 01/2013 account of the consumer may be overhauled by taking consumption as 9170 units which came in the month of 02/2013 and for the month of 02/2013 also consumption of 9170 units may be taken for which the consumer agreed to pay. The case is decided accordingly and account of the consumer may be overhauled as per above decision.

1 Fri 27, Jun 2014  The case came up for hearing before the committee on 27-06-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh..Sumit Vatta CA for Mr. S.K. Vatta on behalf of the consumer appeared before the committee. He has submitted representation along with Power Attorney which has been placed on record. Copy of the same has been supplied to Dy.CE DS Circle, Jalandhar for comments within 15 days i.e. before 14-7-14 with a copy to the representative/consumer for submission of any rebuttal etc. The papers submitted by Dy.CE Jalandhar the following documents are missing:

1 Request of the consumer.
2 Approval of the Chief Engineer. For considering the case under ZDSC.
3 The amount deposited by the consumer along with the receipt No. date etc.
4 The copies attached with the comments of the Dy.CE/DS Jalndhar are not legible. The same be ensured in future that legible copies be supplied. The DDL in this case may also submitted before the next date.
5 The full details of the MCO be given in the comments and copy of MCO may also be attached.
6 The latest position of the connection under Dispute should be given and copies if any be added.

Dy.CE/DS Circle, Jalandhar is directed to submit the above documents before the next meeting. The case is adjourned for the next date
2 Thu 14, Aug 2014  This case, again, came up for hearing before the committee on 14-08-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. S.K. Vatta on behalf of the consumer appeared before the committee and due hearing was given to him. Sh. S.K. Vatta has submitted a rejoinder dated 30-7-14 which has been placed on record, a copy of the same has been supplied to Dy.CE/DS Circle, Jalandhar. Dy.CE/DS, Jalandhar has demanded time to go through the record. The DDL for the concerned period in this case be collected from MMTS and be brought on record by the Dy.CE/DS Circle, Jalandhar. The case is adjourned to the next date.
