4.  ਵਰਨਣ The consumer has represented that he has not been given benefit of TOD tariff reasoning that the DDL of meter is not available.
5.  ਫੈਸਲਾ Brief History: This is LS category connection and the consumer has demanded refund of Rs.1085409/- on account of rebate as per TOD tariff applicable (Rebate on tariff for using power supply from 10 PM to 6 AM). Refund was not given earlier because as per ASE/MMTS Report, the DDL could not be taken due to defect in the meter. This meter was changed vide MCO no. 176235/07149 dated 12.11.13 on dated 24.11.13. The meter was taken to ME Lab vide Store Challan no.71 dated 1.1.14. As per ME Lab report “Accuracy of meter found within limits, DDL could not be downloaded”. Therefore, Meter was got tested from manufacturer company i.e. M/s L&T. On dated 19.2.14, Company gave following report:- “The representative visited at ME Lab Ludhiana (the consumer\'s meter Sr.No.12480245) DDL was not done with optical port due to some internal error with the meter. The meter Data was collected in the presence of Staff members of ME Lab.” Proceedings The consumer in his detailed petition represented that he was regularly using electric supply during night hours to avail the rebate as per PSPCL instructions and since the DDL of this meter could not be taken due to defect in the meter and he has calculated 960539 units from 1.10.13 to 24.11.13 and accordingly the recoverable TOD rebate comes to Rs.1085409/- The PO informed committee that the TOD tariff rebate was not given to consumer from 1.10.13 to 24.11.13 on account of non availability of consumption made by consumer during night. During the previous meeting committee had directed PO to submit 11 KV feeder data at 66 KV Sub Station Kanganwal including the hourly readings of the feeder from where this consumer is being given electrical supply. The same was presented before the committee, which shows that the consumer was regularly running his factory from 10 KHK Alloys (A/c no.LS 319) PM to 10 AM. P.O. also presented the chart showing monthly reading recorded by Xen and the consumption alongwith TOD rebate availed by the consumer from 24.11.13 to 15.5.14. Observations The committee studied the given Sub Station data of this feeder and observed that the consumer was regularly running his unit from 10 PM to 10 AM. PO further informed the committee that one more LS category connection namely M/s S.N.Forge Pvt.Ltd. was also released on this feeder on 28.10.13 but this consumer did not get any TOD rebate upto 24.11.13 which shows that only the load of M/s KHK Alloys was running on this feeder during the night time. Committee also studied that consumption chart viz-a-viz TOD tariff rebate given to the consumer on the basis of various DDL reports. Committee also observed that from 16.4.14 to 15.5.14 total consumption of 9,12,360/- units was recorded by meter installed at consumer\'s premises out of which he got TOD rebate for 4,60,470 units as per DDL print out report, which shows the percentage of units consumed during night i.e. from 10.PM to 6 AM was 50.47 % of the total units consumed. Decision After detailed deliberation committee unanimously decided as Under :- As per the history submitted by the Addl.SE,Estate Division,Ludhiana he has given the consumption from 16.10.13 to 15.11.13 as 738930 units, From 15.11.13 to 24.11.13 the consumption is 187400 units. From 1.10.13 to 15.10.13 the consumption may be taken from the reading recorded at the time of re setting of MDI on 30.9.13 and the total consumption from 1.10.13 to 24.11.13 will be calculated as explained above and out of that consumption 50.47% the consumption may be taken as consumption during night time which is admissible for TOD rebate and refund, If the KWH reading is not available on dated 30.9.13, the total consumption from 16.9.13 to 16.10.13 i.e.7,34,520/- units may be reduced to 1.10.13 to 16.10.13 on proportionate basis. Revised calculations should be prepared and the consumer should be informed accordingly. The case is decided.
