5.  ਫੈਸਲਾ Brief History This is a de-clubbing case of 2 no. MS connections i.e. MS-32/13 in the name of Sh. Prem Pal (M/S S.K.Weaving Factory, 207, Ind. Area-A) sanctioned load 65.800KW and MS-32/36 in the name of Sh. Prem Pal (M/S Vardhman Textile, 213, Ind. Area-A) sanctioned load 57.75KW. These connections were identified for clubbing by CMC Divn., Ludhiana(on the basis of report of JE-1 of CMC Divn.) and the consumer was informed by ASE/Op.,CMC Divn, Ludhiana vide memo no.1017 dt. 03.02.1998. The above said connections were also checked by Sr.XEN./Enf., Tarantaran on dt. 27.4.2001 and directed for levying higher tariff (LS). These connections were charged higher tariff (LS) by CMC Divn. since 01/1998 and the consumer was regularly paying the bill. Afterwards, these connections were checked by ASE/Enf-1, Ludhiana vide LCR no. 14/361 dt. 26.10.2010 (A/c no. MS-32/13) and LCR no. 15/361 dt. 26.10.2010 (A/c no. MS-32/36) and also reported that both the connections are clubbable. Now, Sh. Subhash Chander(partner in M/S S.K.Weaving Factory, A/c no. MS-32/13) made representation to CMC Divn. for de-clubbing on dt. 14.02.2011. As per LCR no.001/515 dt. 22.02.2011, both the connections are physically and electrically separate. ASE/Op., CMC Divn., Ludhiana vide his memo no. 1637 dt. 19.04.2011 forwarded the consumer request dt. 14.02.2011 to Dy.CE/Op., City East Circle, Ludhiana for further action. Dy.CE/Op., City East Circle, Ludhiana vide his office memo no. 3683 dt. 29.04.2011 requested CE/Op.(C ), Ludhiana for constituting the De-clubbing committee. The De-clubbing committee was constituted by CE/Op.(C ), Ludhiana vide his o/o no. 36 dt. 13.05.2011 which consisted of Dy.CE/Enf., Ludhiana and Dy.CE/Op., City East Circle, Ludhiana. The De-clubbing committee visited the premises of the consumer and in 01/2014 reported that the two connections are de-clubbable. In compliance of CE/Op.(C), Ludhiana memo no. 987 dt. 11.02.2014 which directed the office of Dy.CE/Op., City East Circle, Ludhiana to not to club the above connections, the de-clubbing was made applicable on dt.11.2.14. The consumer having a/c no. MS-32/013 has approached ZDSC and the consumer having a/c no. MS-32/36 has approached CDSC for refund of LT surcharge paid by them in energy bills from 02/11 to 02/14. Proceedings Sh. Subhash Chander Jain, partner in firm appeared before the committee. In meeting dt. 01.08.2014, the consumer submitted his petition to the committee. The committee directed P.O. to present comments on the petition of the consumer and consumption data of both the connections with sanctioned load since 01/2011 onwards, consumer request dt. 14.2.2011 and Checking Register of AEE/T-1 with checking report of 22.2.2011. In meeting dt. 28.8.14, P.O. presented the above said documents before the committee. The committee further directed P.O. to submit the documents relating to clubbing and de-clubbing of connections and also to confirm whether proper procedure has been adopted as per CC no. 17/2004 in this case. In today’s meeting, P.O. presented the above said documents. Observations The committee observed the above documents. The consumer pleaded that as per LCR no.001/515 dt. 22.02.2011, both the connections are physically and electrically separate and hence de-clubbable. Moreover, the de-clubbing committee also submitted its report after a long period of 3 years whereas the de-clubbing committee is required to submit its report within 6 months of its constitution. The consumer further pleaded that it is not his fault. Decision The committee observed that there is no instruction regarding de-clubbing of entitled load as per ESIM (Electricity Supply Instructions Manual). Hence, the de-clubbing of these connections is not permissible.
