5.  ਫੈਸਲਾ Brief History This is a LS connection. The consumer had given his request for reduction of CD from 2745KVA to 2050 KVA on dt.15.06.1998 along with change of industry. But, neither CD nor change of category was affected because A&A forms were not approved by the competent authority. Since in the consumer bill, the CD was being shown as 2745KVA, therefore, 10% voltage surcharge was levied to the consumer in energy bills as per instructions of PSEB (now PSPCL) because his A&A forms were not accepted/approved by the office of CE/Comm., Patiala till then. As per BLRC decision dt.23.08.2001 and DSC decision dt.13.09.1999, CE/Comm. accepted and approved A&A forms vide his memo no.35100 dt.10.08.2010 addressed to S.E./Op., City East Circle, Ludhiana and reduced CD to 2050KVA w.e.f. 15.09.1998. A refund of Rs.2042512/- was allowed by Sr.Xen., CBC vide RBS no. 27/2010 dt. 23.09.2010 from 04/2009 to 06/2010. Earlier, the consumer had approached ZDSC for refund of Voltage Surcharge from 04/2007 to 03/2009. In compliance to the decision of ZDSC taken in meeting dt.11.07.2011, the refund of Rs.4988414/- was made to the consumer from 03/2007 to 03/2009 as per RBS no.100/2011 dt.21.10.2011. Now, the consumer has made request for interest on the refund amount of Rs.4988414. 8/8 Proceedings Sh. Satish Mahajan, Director of the firm appeared before the committee. In meeting dt.23.06.2014, the consumer had requested that his request may be considered as his petition. In today’s meeting, P.O. presented comments of ASE/Op., CMC Divn., Ludhiana on the petition of the consumer, copy of RBS for the amount refunded and the copy of decision of ZDSC dt.11.07.2011 required by the committee in its last meeting. The committee carefully studied the above documents presented documents. Decision The committee deliberated the whole case and unanimously decided that the interest may be allowed to the consumer from the date of request made by the consumer for refund of voltage surcharge i.e.18.08.2010 to the date of approval of refund of 10% voltage surcharge at the rates applicable as per CC 31/2014.
