5.  ਫੈਸਲਾ Brief History This is a LS consumer having sanctioned load of 1375KW. While recording reading on dt. 23.8.14, reading could not be taken due to defective software of the meter. On dt. 28.8.2014, bill for the month of 07/2014 for Rs.5054230 for 645281 units on the basis of adopted average was issued. On the basis of ASE/EA/MMTS-2, Ludhiana memo no. 694 dt. 28.8.14, ASE/CBC, Ludhiana issued RBS vide RBS no.95/2014 dt. 29.10.2014 and overhauled the a/c of the consumer for the months 06/2014 and 08/2014 and charged an amount of Rs.2423595. The consumer being disagreed with the above said RBS, amounting to Rs. 2423595/-, approached the office of CE/Op.,(C) and requested to consider his case for ZDSC which was accepted vide office memo no. 8768 dt. 10.11.14. Proceedings Sh. Girdhari Lal, representative of firm and Sh. Jaswant Singh, counsel of firm appeared before the committee. In meeting dt. 20.11.2014, the committee asked the consumer to give his fresh petition to Sr. XEN., CMC Divn, Ludhiana and P.O. was directed to present comments on the petition of the consumer. In meeting dt. 04.12.2014, the consumer submitted his petition which was handed over to the P.O. for the reply on the petition. The committee observed that as per speaking orders of ASE/EA/MMTS-2, Ludhiana memo no. 694 dt. 28.8.14, the a/c should be overhauled from the date 22.07.2014 but CBC vide RBS no. 95/2014 dt. 29.10.2014 has overhauled the a/c from 25.06.2014. P.O. was directed to get the matter be clarified from CBC and submit the same before the committee in the next meeting. In today’s meeting, P.O. submitted the comments on the petition of the consumer and clarification from CBC as required by the committee in the last meeting which were studied by the committee. Decision In the ZLDSC meeting dt.17.10.2014, the committee gave its decision “the a/c of the consumer be overhauled for the period 23.07.2014 to 30.08.2014 on the basis of average consumption of previous 6 months and RBS be issued accordingly.” As this decision has not been implemented till date, the committee unanimously decided to overhaul the a/c of the consumer as detailed below: As per report of ASE/MMTS-2, Ludhiana vide memo no. 694 dt. 28.08.2014 “mItr dw soPtvyAr krpt hox kwrx mItr dI KWH rIifMg imqI 22.07.2014 qoN bwAd sweIkl kMmplIt kIqy ibnW dubwrw jIro qoN SurU ho rhI hY[ mItr ny imqI 23.07.2014 qoN lY ky imqI 28.07.2014 q~k Kpq irkwrf nhIN kIqI[”CBC vide RBS no. 95/2014 dt. 29.10.2014 has overhauled the a/c from 25.06.2014 to 24.7.2014 and from 23.8.2014 to 23.9.2014. Taking into a/c the report of ASE/MMTS-2, Ludhiana and RBS no. 95/2014 dt. 29.10.2014, the a/c of the consumer from 22.07.2014 to 24.07.2014(i.e. for two days) be overhauled as per average consumption of 06/2014. Further, the period from 24.7.2014 to 30.08.2014, the a/c of the consumer be overhauled as per average consumption of six months from 01/2014 to 06/2014 and from 31.08.2014 onwards, the a/c of the consumer be overhauled as per actual consumption recorded.
