5.  ਫੈਸਲਾ This case, again, came up for hearing before the committee on 21-05-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee. The case has been discussed at length by the Committee and sufficient time has been given to the consumer to bring forth anything to prove his contentions. He has not been able to produce anything either orally or by any documents. The only contention he has insisted upon is the management of his income tax affairs to face the amount now raised against him and moreover today he has pointed out that his written and oral arguments may be considered as final. Thus on deliberations the committee found that the ME Lab report and the site report are same and both are predicting that the MF factor should be 2 instead of 1 and on this basis the account of the consumer is to be overhauled by applying MF factor 2 instead of 1 already charged. Hence the amount is recoverable from the consumer along with the interest applicable under the PSPCL instructions. The case is decided accordingly.

1 Fri 26, Sep 2014  The case came up for hearing before the committee on 14-08-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee.
Sh. Vijay Talwar has filed Power of Attorney to represent the case on behalf of the consumer, which has been placed on record. Sh. Vijay Talwar has demanded copies of documents mentioned in his representation dated 13-08-2014 today and a copy of the same has been supplied to Dy.CE/DS Circle, Jalandhar for doing needful within 7 days. The consumer shall submit his representation within 7 days from the receipt of documents to the Committee with a copy of the same to Dy.CE/DS Circle, Jalandhar for his comments on it within next 7 days thereafter along with the readings and consumption of the consumer for the previous 5 years. In the interest of justice the case is adjourned to the next date.

Dated 26-09-2014: This case, again, came up for hearing before the committee on 26-09-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Vijay Kumar Talwar consumer’s representative alongwith consumer appeared before the committee. The consumer has pointed out that they have not received complete documents as per his earlier requests. The Committee decided and instructed Dy.CE/DS Circle, PSPCL, Jalandhar to provide all documents demanded by the consumer within 15 days.
The consumer also demanded that the reply, if any, regarding his interim petition and reply to show cause notice should also be given by Dy.CE/DS Circle, Jalandhar within 15 days so that petitioner could file his complete petition within next 15 days. Dy.CE/DS Circle, Jalandhar is directed to submit comments on the interim petition and reply to show cause notice of the consumer within 7 days to ZDSC with a copy to consumer. In the interest of justice the case is adjourned to the next meeting.
2 Thu 13, Nov 2014  This case, again, came up for hearing before the committee on 13-11-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee along with Sh. Vijay Talwar his representative. The committee observed that in order to arrive at the correct accuracy of metering equipment i.e. meter and CT/PT and also to find out by testing for the ratio of metering equipment i.e. meter and CT/PT may be got tested as per meter regulation 2006 for the same from accredited ME Lab.Jalandhar before 26th November, 2014 in the presence of consumer/his representative who shall be given 3 days clear cut notice of the day of testing of the meter etc. The copy of result should be supplied to all members and consumer before 28th Nov. 2014. The next meeting of ZDSC shall be held on 01-12-2014. Deputy Chief Engineer/DS Circle, Jalandhar is directed to ensure that copy of all documents demanded by the consumer are supplied and confirmed to the committee. The concerned officers of Enforcement/MMTS is also directed to supply copy of all the print outs of the metering equipment from the date of connection till date to the committee as well as the consumer within 3 days under all circumstances. It has been observed also that the documents supplied to the consumer had not been supplied to the committee and accordingly these copies be also supplied to the committee for necessary action. The case is adjourned to the next date i.e. 01-12-2014.
3 Mon 01, Dec 2014  This case, again, came up for hearing before the committee on 01-12-2014. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee along with Sh. Vijay Talwar his representative. The consumer stated that he has received some copies of the documents which very late and in complete. Er. Gopal Sharma was directed to supply the documents, if any, within 7 days positively to enable him to submit his representation. After the receipt of documents, the consumer shall file his detailed representation within 7 days with a copy to the Dy. CE/DS Circle, Jalandhar for his comments. The next date of metering is fixed for 16-12-2014 but the case be now fixed for hearing in the consecutive meeting on the request of consumer because Sh. Vijay Talwar is to attend conference at Hyderabad.
4 Fri 23, Jan 2015  This case, again, came up for hearing before the committee on 23-01-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee. He has submitted that his counsel Sh. Vijay Talwar is bound to appear in the forum and as such he cannot appear today. He has submitted his application for adjournment.
This case has been adjourned on several occasions but the consumer has not submitted his representation. In the interest of justice and fair play a final opportunity is given to the consumer to submit his representation within 7 days from today to the committee with a copy to Dy.CE/DS Circle, Jalandhar for his comments who shall also forward his comments to the consumer within next 7 days. The case shall be finally taken up on the next date. The case, as such, is adjourned to the next date.
5 Tue 24, Feb 2015  This case, again, came up for hearing before the committee on 24-02-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee along with Sh. Vijay Talwar his representative. The Dy.CE/DS Circle, Jalanhdhar has supplied a copy of his comments to the petitioner. Petitioner shall file his rejoinder, if any, before 12th March, 2015. The case is adjourned for further proceedings.
6 Thu 26, Mar 2015  This case, again, came up for hearing before the committee on 26-03-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee along with Sh. Vijay Talwar his representative. The committee heard both the parties. Both the parties have been directed to submit their complete written arguments within 10 days in the office of Chief Engineer/DS North, Jalandhar. The case is adjourned accordingly for further proceedings.
7 Fri 24, Apr 2015  This case, again, came up for hearing before the committee on 24-04-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Dr. Viney Gupta, consumer, appeared in person before the committee and pointed out that he has got reply to arguments from Dy.CE/DS Circle, Jalandhar on dated 23-4-15 and he needs at least 7 days to submit his rebuttal arguments. The committee agreed to the pleading of consumer and decided that rebuttal may be submitted to Dy. CE/DS Circle, Jalandhar within 7 days who may submit any thing further within the next 3 days if so, needed by him with a copy to ZDSC. Accordingly the case is adjourned to the next date i.e. 15-05-2015.
