5.  ਫੈਸਲਾ This case, again, came up for hearing before the committee on 21-05-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Vijay Talwar representative of the consumer was present. He has already submitted his additional submissions on 14-5-15 which has been placed on record today. Sh. Vijay Talwar has further submitted his synopsis in this case dated 21-05-2015 which have also been placed on record. Sh. Vijay Talwar in his efforts to support his various contentions read out all the synopsis dated 21-05-2015 in detail and was given full opportunity to prove the various grounds taken by him in his arguments etc. In order to arrive at the truth about the functioning of the CT/PT equipment etc. it was considered necessary to record the statement of Addl.SE/EA&MMTS. Sh. Sushil Singh Addl. SE/EA&MMTS-I,Jalandhar who appeared on behalf of Er. Sampuran Singh, Addl.SE/EA&MMTS-II, Jalandhar being on training. In his statement Er. Sushil Singh Addl. SE/EA&MMTS-I,Jalandhar has proved his report made vide Memo. No. 83 dated 20-05-2015 in his statement. From the oral argument of Sh. Vijay Talwar as well as written statements of Addl.SE/EA&MMTS-I, Jalandhar the committee has concluded that red phase CT was contributing though not to its full capacity, as is clear from the report of MMTS which is reproduced below:- DDL RI YI BI R-KW Y-KW B-KW 26-3-12 0.696 4.907 5.177 3.600 25.838 26.128 20-1-13 1.939 5.692 5.185 11.882 33.621 31.456 12-12-13 1.763 4.591 4.029 11.319 28.312 24.193 Also in his statement he has pointed out that on dated 8-5-15 vide ECR No. 19/34 he has again taken the DDL in this case with the changed CT/PT. The results are reproduced below:- \"The DDL of the meter was done on dated 8-5-15 vide ECR No. 19/34 and its parameters (taken at site as well as in the print out) clearly states that current on all the three phases was balanced and its magnitude was also quite high as compared to the parameters of previous DDL as stated above.\" 8/5/15 12.705 12.795 14.069 77.257 74.700 83.734 The tamper data of this DDL studied at different levels of load and observed that the status of current on all the three phases remained balance.\" From the above it is very clear that red phase was not contributing properly from 26-3-12 to 22-12-13. In order to find out the contribution of red phase as compared to the other two phases the committee has taken total contributed by R-Y-B phase 26-3-12, 20-1-13 and 12-12-13 taken together which comes out to be as below:- DDL RI YI BI 26-3-12 0.696 4.907 5.177 20-1-13 1.939 5.692 5.185 12-12-13 1.763 4.591 4.029 Total 4.398 15.190 14.391 Average contribution by Y and B phase 15.190+14.391/2=14.790 Amps. Since red phase has contributed 4.398 against 14.790 which it was supposed to contributed had it worked properly. Hence, percentage contribution of red phase = 4.398/14.790x100=29.736 The same is supported by the test results of ME lab. also. In order to arrive at more precise result the unbalance recorded at the time of checking on LT side is also to be taken into account which is given below (in the report of checking dated 12-12-13):- R-204 Y-215 B-218 From above we can conclude that average load on Y and B phase was as below:- 215+218/2= 216.5 Amps. Due to unbalancing of load the red phase was contributing equal if 204 Amps of red phase is taken as 216 Amps of average of Y and B phase i.e. 216.5 Amps. This correction factor if applied and adopted on the above contribution by the red phase will be 29.736x216.5/204=31.558 %age (ratio error) which tallies with the results obtained in the ME Lab. From the above it is clear that red phase was contributing 31.558 % of what other two phases were contributing. From the record supplied by the Dy. CE/DS Circle, Jalndhar it was found that in the month (Jan. and Feb, 2012) 50% extra consumption has been charged on actual consumption considering red phase dead but actual checking was done on 26-3-12 and the date from which the amount was to be charged was 14-3-12 as based on DDL done on 26-3-12. Hence for Feb.2012 no amount is to be charged. And for March, 2012 only period from 14-3-12 onwards till the defective CT/PT was changed is to be charged from the consumer. In order to give clear cut picture as to how the calculations are to be made, example for a month is given below:- 1. Suppose No. of Units consumed in one month = 60000 Units. 2. No. of units charged as per RBS =90000 units. (60000x1.5) 3. No. of units chargeable as per ZLDSC decision comes to 77733 as calculated below:- Suppose X units was to be contributed by each phase then X+X+.3156X=60000. Hence X comes = 60000/2.3156=25911.21 Hence the correct consumption would have been 3x25911.21=77733 had red phase contributed properly fully. Thus the MF for calculation of correct consumption comes to 1.2956 (77733/60000). The case of the consumer is decided accordingly as above and the account of the consumer may be overhauled for the period 14-3-2012 to 12-12-2013 by multiplying the actual consumption by 1.2956 as above instead of 1.5 (as charged in RBS) and charged accordingly as per instructions of PSPCL.
