5.  ਫੈਸਲਾ History This is LS category consumer. The consumer was issued bill by CBC for the month of 6/2014, and was issued on 18.7.14. The bill amount was Rs.6017725/-. After rounding off, the amount payable by consumer was Rs.6017730/-. The consumer made payment of Rs.6017725/- vide RO-4 no.99 dated.28.7.14. In the next bill of 7/14 the consumer was levied surcharge of Rs.536530/- + Rs.5/- making total amount of Rs.536535/- as surcharge amount. AEE(Commercial) accepted the bill of consumer by subtracting the surcharge amount and advice was sent to ASE,CBC. But ASE/CBC, Ludhiana did not accept the advice of Estate Division, Ludhiana and advised to put the case in ZDSC. In the meantime, the bill for the month of 8/2014 issued on 7.9.14 was also accepted by Estate Division, Ludhiana after subtracting the surcharge amount levied in the bills of 6/2014, 7/2014 and 08/2014, amounting to Rs.1038540/-. Proceedings The consumer in his petition submitted that the bill of June, 2014 was paid for Rs.60,17,725/- while the rounded off bill amount was Rs.6017730/-. In the bill of next month i.e.7/14, SDO corrected the bill amount by subtracting the surcharge amount and similarly in 8/2014 also the bill was got corrected from the office of PSPCL. He further submitted that surcharge/penalty charged to him for depositing Rs.5/- less in 6/2014 was very harsh and requested for waiving off the same because just for depositing Rs.5/- less inadvertently, he was penalized by imposing huge penalty amount. Observation Committee deliberated the case and observed that it was a bonafied mistake on the part of the consumer as he inadvertently deposited Rs.60,17,725/- instead of bill amount of Rs.60,17,730/-. Thus, depositing Rs.5/- less than the bill amount, the surcharge amount in Bansal Spinning Mills (A/c no.LS 74) the next bill and subsequent bills totaled to Rs.1038540/-, as the O/O Estate Divn. Ludhiana kept on accepting the bills for the month of June, July and August, 2014 by subtracting the surcharge amount. Committee further observed that AEE(C) Estate Division should not have corrected the subsequent bills which only added to more surcharge amount and inconvenience to the consumer. PO brought to the notice of the committee that as per ESIM clause 76 dealing with “adjustment of late payment charge”, if the consumer make part payment of the bill, the amount received shall be credited first towards the PSPCL dues especially surchargeable items for example meter and service rental, sundry charges, line maintenance and lamp renewable charges etc. and towards the energy charges. The balance if any, may be then adjusted towards the electricity duty and octroi etc. Decision After detailed deliberation, committee unanimously, decided that in view of Regulation 76 of ESIM, the surcharge amount of Rs.1038540/- is not recoverable from the consumer. However, committee directed that AEE(C) and RA of Estate Division, Ludhiana should be advised to be careful in future and should not alter the bills prepared by ASE/CBC, Ludhiana because their small mistake has caused avoidable inconvenience to the consumers and valuable time of the ZDSC has been wasted in deciding this case. The consumer should be informed accordingly.
