5.  ਫੈਸਲਾ This case, again, came up for hearing before the committee on 14-08-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Gurpreet Singh Advocate was present on behalf of the consumer. In order to arrive at the factual position in this case, the report of Addl.SE/Energy Audit & MMTS-2, PSPCL, Jalandhar was called for which has been received vide his Memo. No. 185 dated 12-8-15 which has been placed on record and for purposes of proper appreciation which is reproduced as under:- \"The sub cited connection was checked on dated 12-12-13 vide ECR No. 32/1716 regarding display of abnormal voltage on the B-phase of the L&T make meter. During initial examination it was observed that voltage on meter terminal ends from phase-phase and from phase-neutral was in order, but meter was displaying 8461 V on its B-phase where as voltage on other (R&Y) Phases was 6023 V & 6047V. These observations made it clear that meter has got defective. To investigate further its (Abnormal Voltage) effect on the meter, meter\'s accuracy got checked and found it to be slow by minus (-)17%. Print out\'s of previous DDL done on 6-9-13 vide ECR No. 40/1703 on battery mode and the latest print (12-12-13) were also scrutinized and found that this meter was displaying high voltage on its B-phase since 8-7-13 (last date projected in the print out), it means that this defect in the meter was prevalent before 8-7-13 (KWH=16869000 with emf). In the tamper data print out of DDL done on 12-12-13 it was also noticed that load on R,Y,B Phases was 17.16, 17.35, 8.73 KW whereas Current at that time was 3.06, 3.06, 3/04 Amp projected in the instantaneous parameters and phase/current sequence was not in order i.e. RYB & RBY(this type of sequence slows down the meter), but at the display of the meter it was in order i.e. RBY & RBY. This feature clearly states that the abnormal high voltage on B-phase was responsible for all this mess created in the internal software of the meter and in addition to that the internal Phase/Current sequence order projected in the print out has solwed down the meter as being projected in the loading on B-phase i.e. 8.73 KW load and subsequently this phenomena resulted (-17% slow) during testing of the meter. The print out of DDL done on dated 16-2-15 in ME lab., Jalandhar, it was observed that in one slot of power failure time and duration the period was 31-12-13 to 15-3-15 and in the second slot it was 31-12-13 to 17-3-15 when the meter was remain non energized. The meter was removed from the consumer premises on dated 31-12-13 and was energized in the ME lab on dated 16-2-15 but surprisingly print out states that it was energized on dated 15-1-15 and in another slot it was 17-3-15. It was also observed that up to dated 29-12-13 voltage on R.Y.B. Phases were 64.7, 64.7, 83.5 V and at the time of removal of meter on dated 31-12-13 the load was removed from the meter (voltage on B Phase was still 83.5 V) and when load was again put on the system after 5 mts the voltage on B-Phase became 58.8 V and Current shoot to 5.00A on all the three phases. The meter was removed at this position (the voltage on all the three phases had become normal). On dated 16-2-15 meter accuracy was got tested in the ME lab (the voltage on all the three phases was normal) and the results so obtained were in permissible limits. From all these observations it’s clear that meter software had become erratic and at the time of its accuracy being checked in the found conditions its impact was on the accuracy of the meter. When the meter was removed from the premises its voltage became normal and when charged in the ME lab for its accuracy to be tested the erratic behavior thus corrupted its RTC in the power failure data and not on its accuracy as it did previously when tested in the consumer premises in the found conditions and so results of the meter came within permissible limit. Thus by considering all these different type of observations at site, in the print outs, in the ME lab it is concluded with all the evidences produced that the abnormal Voltage on the B-Phase (which had made the functioning of the meter erratic) was responsible for all these abnormal features projected at different dates and in different intervals and so these made the meter slow and the energy so recorded during this period was less. In view of the above the committee has deliberated in detail and has come to the conclusion that the total amount charged from the consumer is fully justified and is recoverable. The account of the consumer be overhauled as per instructions of PSPCL.
