The Petitioner is a large supply seasonal (Rice Sheller) connection with A/C No.M25Sh0100001 under the name of M/S thind Agro Foods(P) Ltd.,Village Lumbriwala.The PPCB issued directions vide letter no. 838 dated 23.02.2010 to temporarly disconnected the connection of the consumer (Petitioner).In order to stop the consumer from running industry without PPCB clearence,two phases of the supply were temporarly disconnected from period 05.03.2010 to 16.01.2014 vide TDCO no. 88/74962 dated 04.03.2010. This was done to comply with the direction of PPCB.The supply was temporarily restored on 17.01.2014 for a period of 6 months as per the direction of PPCB issued vide letter no 72/73 dated 08.01.2014. The connection has been again temporarely disconnected vide TDCO no.74/79069 dated 14.07.2014 effected on 16.07.2014 as per the direction of PPCB received vide their letter no 73 dated 08.01.2014. During this period, the billing was done by Computerised Billing cell as per general conditions of tariff of PSPCL.However the petition is now demanding refund of the bills issued on MMC during the period from 05.03.2010 to 16.01.2014.

After hearing the consumer & Presenting officer the ZDSC decided that the electricity connection of M/S thind agro food having account no. M25SH01/00001 was disconnected by PSPCL on the direction of punjab pollution control board(PPCB) for want of clearance. The supply of the firm the restored for a period of 6 month on the direction of P.P.C.B. During the period of disconnection MMC tariff was charged to the consumer. Since the connection in
Question disconnected due to firm own fault and the system of PSPCL remained as usual so the amount of MMC is recoverable from the consumer.
