4.  ਵਰਨਣ Meter print out data of M/S NFL ltd. bathinda was retrieved by sr. xen MMTS bathinda on dated 18-9-13. As per D.D.L print out the firm violated the peak load restriction from 15-7-13 to 8-9-13. A penalty of Rs 12003665/- was imposed to the firm. Accordingly a notice was served to the firm by AE commercial-1 vide their letter no. 5124 dated 20-11-13 to deposit the said amount but the firm replied that the amount is not chargeable as the firm obtained approval to run the load during the peak hours . After that AE commercial-1 Bathinda written a letter to sr. xen MMTS bathinda to check again the said meter data of the firm. After that sr. xen MMTS bathinda revised the amount of penalty from Rs 12003665/- to Rs 8379435/-. Revised notice was issued to the firm to deposit the amount on dated 17-5-14 by cheque and 19-5-14 by DD but the firm did not deposit the amount. So the total amount of penalty plus surcharge Rs 9217379/- is recoverable from the firm.
5.  ਫੈਸਲਾ The electricity meter of M/S NFL ltd Bathinda having A/c no B11BC01/0009 was declare defective by MMTS Bathinda on dated 08-08-2012 due to non working of display. Billing of consumer from 08-12 was done from meter installed in circuit no 1 at GNDTP site. On the other side meter at consumer site recording reading but not displaying. After hearing the consumer and Presenting officer the Zonal level committeeon dated 21-11-2014 and directed the P.O. to bring the complete recording report of the meter from MMTS Bathinda office regarding peak load violation , consumption detail ,time display and actual time. The case is deferred for next hearing. The ZDSC meeting held on 05-12-2014 and in prior meeting it was decided to bring the DDL report of the meter from MMTS Bathinda, as the report submitted by MMTS bathinda vide their letter no 1040 dated 04-12-2014 was incomplete. So the committee directed Add/SE MMTS bathinda to put up the complete report before the committee personally in the next meeting. The committee decided to defer the case for next hearing The ZDSC meeting was held on dt.27.01.15. Add.S.E. M.M.T.S. Bathinda appeared before the committee and submitted complete report of M/s N.F.L, that on dt. 08.08.2012 due to low voltage battery problem the DDL of the meter could not be retrieved. On dt. 18.09.2013 DDL of the meter successfully retrieved. Beside this it was also reported that time display of the second meter of the consumer lagging by 33 Minutes. So while calculating the amount of penalty this fact was also considered so as such Rs 79,61,435/-is recoverable form consumer. After hearing the consumer & Presenting officer the ZDSC decided that as per the DDL record of the meter peak load violation charges are correct and Rs 79,61,435/- recoverable as per standing instruction of PSPCL along with surcharge/Interest.
