5.  ਫੈਸਲਾ Brief History This is a LS connection having sanctioned load of 799.542KW. On dt. 15.09.2014, the consumer gave his option for TOD tariff from dt. 01.10.2014 in the concerned division office vide diary no. 3191 dt. 15.09.2014. On dt. 02.02.2015, the required DLMS meter was installed in the consumer’s premises vide MCO no. E32/M/15/229730/14949 dt. 02.02.2015. The consumer was allowed to run 500KW load during Peak Load Hours, the PLEC charges of which were being deposited by him in the monthly energy bills. The additional PLEC charges in the monthly bills charged by CBC, Ludhiana are as follows: Time Period Amount(in Rs.) 27.09.2014 to 26.10.2014 117013 26.10.2014 to 26.11.2014 109463 26.11.2014 to 27.12.2014 117013 27.12.2014 to 28.01.2015 120727 Total 464216 The consumer deposited the whole amount. The consumer, now, wants the refund by overhauling his a/c from 01.10.2014 to 02.02.2015 and approached the office of CE/Op.,(C ) to consider his case for hearing in ZLDSC which was accepted vide office memo no. 1430 dt. 02.03.2015. Proceedings Sh.K.D.Parthi, counsel of firm appeared before the committee. In meeting dt. 27.03.2015, the consumer submitted his detailed petition to the committee. The committee directed P.O. to submit parawise comments on the petition and other relevant documents, if any, in the next meeting. In meeting dt. 21.05.2015, P.O. presented the comments on the petition of the consumer, which were studied by the committee. The committee directed P.O. to submit option letter of the 4/9 M/S Perfect Dyeing & Finishing Industries Account no: FP-54/00554 consumer for TOD tariff and documentary evidence showing the date of receipt of the same in the concerned office such as diary no./seniority register, if maintained as well as details of calculation of applicable Rebate of TOD in the next meeting. In today’s meeting, P.O. presented the above said documents required by the committee in the last meeting. Decision The committee observed that the firm gave its option letter for TOD on dt.15.09.2014. The committee studied Director/D memo no. 2019/45 dt. 11.9.14, deliberated the whole case and unanimously decided that as per prevailing instructions issued vide CC 46/2014 of PSPCL for TOD, the necessary TOD rebate be given to the consumer after taking consumption record from MMTS and fresh RBS be got issued from CBC.
