5.  ਫੈਸਲਾ Brief History This is a LS connection having sanctioned load of 495KW. ASE/MMTS-1, Ludhiana took DDL of the meter on dt. 11.11.2014 and reported vide letter no. 2 dt. 08.01.2015 that the meter has been recording zero current on red phase since dt. 14.08.2013. Sr.Xen./CBC, Ludhiana vide RBS no. 8/2015 dt. 09.02.2015 overhauled the a/c of the consumer from dt. 14.08.2013 to 30.11.2014 and charged an amount of Rs. 4830784. The consumer was informed to deposit the above charged amount by the concerned Divn. office vide notice no. 5023 dt. 19.02.2015. The consumer, being disagreed with the amount charged, approached the office of CE/Op.,(C ) to consider his case for hearing in ZLDSC which was accepted vide office memo no. 1464 dt. 02.03.2015. Proceedings Sh. Sukhminder Singh, counsel of firm appeared before the committee. In meeting dt. 27.03.2015, the consumer submitted his detailed petition to the committee. The committee directed P.O. to submit parawise comments on the petition and any other relevant documents, if any, in the next meeting. The committee further directed P.O. to get the CT/PT unit checked from ME Lab and submit ME Lab report in the next meeting. In meeting dt. 21.05.2015, P.O. submitted the parawise comments on the petition of the consumer, a copy of which was given to the consumer for rejoinder, if any. The committee again directed P.O. to get the CT/PT unit checked from ME Lab in the presence of the consumer representative and the concerned ASE/MMTS-1 who had checked the site/meter. In today’s meeting, P.O. submitted the ME Challan no. 51 dt. 05.06.2015 vide which “result of CT/PT unit tested in ME Lab found to be within limit.” Decision The committee studied DDLs dt. 8.7.13, 17.9.13, 26.11.13, 5.2.14, 16.4.14, 19.6.14, 27.8.14, 11.11.14, 18.11.14, MMTS report vide memo no. 2 dt. 8.1.15 and deliberated the whole case. The committee unanimously decided that the amount charged to the consumer w.e.f. 14.08.2013 for red phase current zero as per MMTS report is correct and chargeable. Further, the committee 6/9 M/S Diana Mining Equipment Account no: FP-57/0903 found that while calculating demand surcharge, CBC should have given the benefit for sanctioned CD (i.e. 495 KVA) whereas it reduced already recorded MDI, which is not correct. Accordingly, fresh RBS be got issued. The committee was of the view that the case had been kept unnecessarily under observation for such a long period by the concerned ASE/MMTS-1, Ludhiana. Thus, the committee directed P.O. to bring this matter to the notice of SE/Enf., Ludhiana for required action.
