5.  ਫੈਸਲਾ History This is NRS connection of 1998.950 KW/2221.05 KVA and supply is being used for Hospital (Appollo Hospital). Supply of this consumer was being used through 11 KV independent feeder and the same was declared as essential services feeder and consumer was paying 25% extra tariff for getting the uninterrupted supply. The consumer applied for converting this essential feeder into general category feeder and the same was allowed by CE/PP&R vide his office memo no. 6939 dated 18.9.14. As per this letter CE/PP&R allowed the feeder to be converted into general category feeder w.e.f. 18.9.14 i.e. the date of issue of letter. The bill from 16.9.14 to 15.10.14 was issued to the consumer as essential services feeder i.e. consumer was charged 25% extra. Subsequently, from 21.10.14 this feeder is being treated as general category feeder. Proceedings The consumer in his petition submitted that he applied for withdrawal of continuous process /essential services facility and the same was allowed by the CE/PP&R vide his office memo no. 6939 dated 18.9.14 and it is mentioned in the letter that the same is applicable from the date of issue of the letter i.e. 18.9.14. Immediately, after receiving this letter, the consumer informed to ASE/Estate Divn. Ludhiana on dated 29.9.14 in writing in addition to personal visit to the Office of ASE/CBC also. But his feeder was treated as general category feeder w.e.f. 21.10.14. The consumer further informed the committee that it was the duty of PSPCL to got the letter from CE/PP&R on dated 18.9.14 and the consumer has been unnecessarily charged the amount of Rs.9,49,257/- on account of 25% extra tariff for treating this feeder as essential services feeder. During the previous meeting PO was told to get the report from SSE,66KV Sub Station Giaspura regarding implementation of power cut instructions from 18.9.14 to 21.10.14 on this feeder. Accordingly PO presented memo no.336 dated 3.12.14 written by Appollo Hospital (CS01/0049) SEE/Giaspura to ASE, Estate Divn. Ludhiana. As per this letter, from dated 18.9.14 to 21.10.14 power cut for 20 minutes to 45 minutes was imposed on category-I feeder but 11 KV Appollo feeder was not subjected to any power cut up to 21.10.14. Observations Committee studied the petition and its reply given by the PO and also the subsequent report of SEE, Giaspura and observed that O/O CE/PP&R had issued the letter vide memo no.6939 dated 18.9.14 addressed to CE/Central Zone,Ludhiana regarding conversion of this feeder to general category feeder and copy of this letter was also marked to various other offices also. But no office sent this copy to SEE/Giaspura who was to actually implement the instructions of CE/PP&R. Decision After detailed deliberation, committee observed that the consumer had persuaded the case in the office of ASE/Estate Divn. as well as ASE, Billing regarding conversion of this feeder from essential services feeder to general category feeder which should have been got done by the ASE/Estate Divn.Ludhiana by sending instructions to SSE,Giaspura well in time. Now as per the memo no. 336 dated 3.12.14 written by SSE Giaspura to Estate Divn. Ludhiana he has intimated that power cuts of 20 minutes, 30 minutes, 30 mintues, and 40 minutes was not imposed on 11 KV Appollo feeder on dated 19.9.14, 1.10.14, 7.10.14 and 13.10.14 respectively due to non communication of letter of CE/PP&R. To be fair to the consumer and to meet the ends of natural justice, committee unanimously decided that the consumer should not be charged extra 25% amount from 18.9.14 to 21.10.14. However, consumer may be charged for 4 days i.e. days when power cut was imposed on other category-I feeders but not imposed on 11 KV Appollo feeder. Revised calculations should be prepared and the consumer should be informed accordingly.
