5.  ਫੈਸਲਾ History Dy. Chief Engineer/west Circle Ldh. vide his letter no. 11933 dt. 10.10.13 cleared the feasibility of the consumer as per feasibility clearance condition no. 1 Load/CD will be released after bifurcation of existing 11 KV Perfect Forging feeder emanating from 66 KV S/S Giaspura. The cost if any will be borne by the consumer as per standing instruction of the PSPCL.The consumer vide A&A no. 49311 Dt. 7.11.13 was applied for load and contract demand, the demand notice no. 584 Dt. 21.11.13 was issued. AO field Ludhiana pointed out in his letter 2039 Dt. 12.9.14 that as per supply code clause 9.1.2 (i)(b) where total load including existing load exceeds 500 KW/KVA the consumer will pay per KW/KVA charges for the additional load/ demand as approved by the commission or the actual expenditure for release of load/ demand which ever is higher. He pointed out Rs. 1714642 short assessment from the consumer. On the basis of this report AEE/Estate Divn. Ldh served a notice to the consumer amounting to Rs. 1714642/- vide his letter no. 3461 Dt. 16.10.14. Processing Today Sh. Angad Singh partner appeared before the committee and submitted that he should have been asked to deposite the amount as per supply code clause 9.1.2(i)(b) at the time of issue of demand notice now it is not justified as per above mention clause. In the dispute case of M/s Big Ben Exports (LS-148) The case was heard on Dt. 4.12.14,19.12.14 and 28.1.15. In the previous meeting held on 19.12.14 a joint committee comprising of Dy CA Central Zone Ludhiana and S.E/West Circle Ludhiana to scrutinize and submit his report in the next meeting. PO submitted the joint report comprising of Dy.CA/Central Zone Ldh. and S.E/West Circle Ldh. Decision The committee deliberated the case and observed that the amount as per estimate was Rs. 2533902/- and service connection charges per KW calculated to be Rs. 668000/-.The consumer already been deposited Rs. 819260/-. As per supply code clause 9.1.2(i)(b) where total load including existing load exceeds 500 KW/KVA the consumer will pay per KW/KVA charges for the additional load/ demand as approved by the commission or the actual expenditure for release of load/ demand whichever is higher. Therefore it was decided by the committee that Rs.1714642/- charged to the consumer is correct and recoverable from the consumer.
