5.  ਫੈਸਲਾ History This is a LS consumer. Sanctioned contract demand of the consumer was 2490 KVA and the consumer was enhanced 4010 KVA CD vide SCO No. 154/73911 dt. 17.10.12 effect on 20.9.13.The feasibility of the consumer was cleared by Chief Engineer/commercial Patiala vide memo no. 23100/Ind/122/ LDh Dt. 18.5.10 As per feasibility clearance “It has been decided to allow you to register A&A forms for release to extension in load of 5510.253 KW/4010KVA CD to the existing load of 4489.747KW/249KVA CD of your subject cited connection thus making the total load as 10000KW/6500 KVA CD along with conversion of supply voltage from 11 KV to 66 KV. The load /CD after extension shall be released at 66 KV through solid tapping of the 66 KV Aarti International – Sahnewal Line (mother S/S 220 KV sahnewal) as per the proposal submitted by Dy.CE/DS,City West Circle,Ludhiana.” Demand notice number 1290 dt. 15.12.10 for Rs. 3631800/-(ACD) was issued. The amount raised vide this notice deposited by the consumer on dt. 23.6.11 and given his test report on dt. 10.10.12. AO field Ludhiana pointed out in his letter 1238 Dt. 24.6.14 that as per supply code clause 9.1.2 (i)(c) and Commercial Circular No. 31/2012, proportionate cost of backup / common line and cost of bay not deposited by the consumer. On the basis of this report AEE/Estate Divn. Ldh served a notice to the consumer amounting to Rs. 2745000/- vide his letter no. 1211 Dt. 7.11.14. The consumer did not deposit the amount and approached to CE/Central for registration of his case in ZDSC. The case was register in ZDSC vide his office memo no. 9180 dt. 25.11.14. The consumer deposited Rs. 2790320/- as per CE/DS Central Ldh letter referred above vide BA 16 No. 213/47959 dt. 25.11.14. The case of the consumer was heard in ZDSC on dt 4.12.14, 19.12.14, 28.1.15, 13.2.15 and finally on dt. 27.3.15. Proceeding Sh.Asoke Dhall and Sh.J.L.Badwal Manager attended the meeting they submitted that they submitted that amount should be charged as per their revised petition. PO submitted the joint report comprising the Dy. CA/Central Zone Ldh and S.E/West Circle Ldh. as desired in the previous meeting. Committee asked the PO to submit reply of the consumer’s petition and also confirm the length of common line in the next meeting. Decision PO submitted the reply of the petition ,the committee after going through the whole case and taking into consideration the reply of the PO and decided that proportionate cost of bay and common should be charged taken into consideration the total capacity of bay/ common line as 43.5 MVA. So, as per CC 68/2008 read with regulation 9.1.2(i)(c ) of electricity supply code. The following amount is to be recovered from the consumer. Total Length of Line = 11.03 Km Santioned Load = 6500 KVA Total carrying capacity on Bay /Line =43500KVA B) Fixed charges Extention in CD = 4010 KVA Fixed Service connection charges 900x4010 = 3609000/- B ) Actual Cost recoverable i) Cost of Service line as per estimate no. TLW/64/Deposit/2010-11(Annexure-A chargeable amount to the consumer in lieu of the option of own material and own labour ) of Sr.Xen.TL Div. Mohali and letter No.3947/52/TLW dated 23.12.2010(Supervision cost) =2414943/- (i) ii) Proportionate cost of Bay Standard Bay Cost 4100000/-( as per CC68/2008) Total carrying capacity on Bay =43500KVA Proportionate cost of Bay (Rs) = Standard Cost of Bay x Sanctioned Load Total load on Bay (KVA) = 4100000 x 6500/ 43500 = 612644/- (ii) iii) Proportionate cost of Backup / Common Line Standerd Line Cost 1246000 As per CC no.68/2008 Total carrying capacity on Line =43500KVA Proportionate cost of Line (Rs) = Standard Cost of Line x Length of Line x Sanctioned Load Total load on Line (KVA) = 1246000 x 11.03 x 6500 / 43500 = 2053609/- (iii) Actual Cost recoverable(i+ii+iii) = 2414943+612644+ 2053609 =5081196/- Total recoverable amount(A or B) whichever is higher = 5081196/- Already paid as per EstimateBA16 no.264/906 Dt. 16.5.11(-) = 2414943 To be Paid = 2666253/-
