5.  ਫੈਸਲਾ This case, again, came up for hearing before the Committee on 28-1-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Amanvir Singh Partner of the firm appeared before the Committee in person. Addl. SE/Enforcement-2, Jalandhar who is present to-day i.e. on 28.1.16 and vide his office letter No. 33 dated 25-1-16 placed on record he has enclosed letter No. 7 dated 25-1-16 from the Sr. Xen/Enforcement-I, Jalandhar wherein it has been intimated that they have gone through all the record on the subject and that the connection in question was never checked before 4/2015 and that there is no correspondence available in this regard. The case has been deliberated at length by the Committee. Note under Clause 21.5.1 of Electricity Supply Code and Related Matters Regulations-2014 is quite clear and is reproduced as under:- \"Where accuracy of meter is not involved and it is a case of application of wrong multiplication factor, the accounts shall be overhauled for the period this mistake continued.\" After deliberations, the Committee came to unanimous conclusion that the amount is chargeable and account of the consumer be overhauled along with interest as per instructions of PSPCL. It is also observed by the Committee that due to lapses by various officers/officials, multiplication factor was applied wrongly, for which Committee recommends disciplinary action against officers/officials responsible for feeding wrong MF and not identifying it for such a long time. It should be preceded by Addl.SE/Enforcement-II, Jalandhar who is already seized of the facts and is conducting the enquiry.

PROCEEDINGS: This case came up for hearing before the committee on 10-07-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Amanvir Singh Partner of the firm appeared before the committee in person. The history of the case revealed that the consumer has filed his case in the Civil Court also. In view of the fact that the case is now pending in the civil court and the next date is fixed 15-7-15 as informed by the Deputy Chief Engineer/DS Circle, Jalandhar. Sh. Amanvir Singh Partner has submitted his written undertaking that he would withdraw the court case in this behalf before the next date of hearing in the court i.e. 15-7-15. He requested that he may kindly be given time to submit his representation to the ZDSC. In the interest of justice the case is adjourned to the next date for necessary action.
2 Fri 14, Aug 2015  This case, again, came up for hearing before the committee on 14-08-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. The consumer has reportedly withdrawn the case from the court. He has submitted an application through speed post dated 12-8-2015 stating that his son Amanvir Singh is out of station and is expected to return on 16th August, 2015 and has requested for exemption on 14-8-15. The case is adjourned accordingly to the next date in the interest of justice.
3 Thu 24, Sep 2015  This case, again, came up for hearing before the committee on 24-09-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Hardev Singh Partner appeared before the committee in person. He has submitted his representation dated 24-9-15 which has been placed on record. A copy of the same has been supplied to Dy. CE/DS Circle, Jalandhar. A copy of the same has also been supplied to the other members of the committee. The Dy. CE/DS Circle, Jalandhar is directed to give his detailed comments on the representation within 10 days to the committee with a copy to the consumer who will give his rebuttal, if any, within the next 10 days thereafter. The case is adjourned to the next date.
4 Wed 21, Oct 2015  This case, again, came up for hearing before the committee on 21-10-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Hardev Singh appeared on behalf of Shree Ram Food Products. In the last meeting he has submitted his petition and the same was handed over Dy.CE/DS Circle, Jalandhar and as per statement of Dy.CE/DS Circle, Jalandhar he has handed over the reply to Sh. Hardev Singh on dated 20-10-15. However, Sh. Hardev Singh pleaded since the letter is in Punjabi and he has no knowledge of Punjabi. He wants time to submit his representation. The committee also deliberated that a letter Memo. No. 1725 dated 13-8-12 was written by AEE/Comml.5 to Addl. SE/Enforcement-II, Jalandhar for verification of particulars of the meter and CT and in his letter he has calculated MF as 2. The then Addl. SE/Enforcement-I, Jalandhar should be called along with AEE Comml-5 in order to find the truth why the meter was not checked by Enforcement for 2 years and 8 months and AEE Comml., RA and UDC Revenue be also directed to appear before the committee along with original consumer case and relevant record in the next meeting. In the interest of justice the case is adjourned to the next meeting.
5 Fri 20, Nov 2015  This case, again, came up for hearing before the committee on 20-11-2015. Er. Gopal Sharma, Dy.CE/DS Circle, Jalandhar presented the case before the committee. Sh. Pavandeep Singh a relative of Sh. Hardev Singh was present in person today. He has submitted his application dated 20-11-2015 signed by Sh. Hardev Singh wherein he has requested that he had a court hearing of Session Court Kapurthala and cannot come and the other partner Sh. Amanvir Singh is out of city and has requested to adjourn the case to next date. This case is pretty long and adjournments are being sought on one pretext or the other. Er. Ravinder Singh Addl.SE/Enforcement-2, Jalandhar was present and he has stated that he was posted from March, 2014 as Addl.SE/Enforcement-2, Jalandhar and incharge of this area. He further stated that he has not checked this connection upto 4/15. The only checking carried out in his period was on April, 2015. Regarding checking prior to 4/15, it is not very clear whether some body checked or not. He is directed to consult the records and be sure to give his clear cut statement regarding checking before 3/14 in the next date of hearing.
Er. Paramjit Singh AE/Commercial Sub-Divn. JAL was present today in person. He has stated that he was posted in Commercial Sub-Division and the checking was to be carried out by AE/Technical. Er. Ravinder Singh Addl.SE/Enforcement-2 Jalandhar is finally directed to provide the information as asked for today earlier. The case is adjourned to the next date of hearing in the interest of justice.
