5.  ਫੈਸਲਾ The case of the consumer has been reviewed on dt. 28.10.2015 in the ZDSC on behalf of representative of the firm Er.R.S. Sahota was present in the meeting and he told that the firm had obeyed the RTC rules at the time of peak load hrs. and he also told that in the month of June, July and August there is no violation of peak load from 6.30 PM to 9.30 PM. The consumer has told on dt.. 8.6.2015 in the office of Operation Sub Division Nangal that RTC is 22 Minutes advance as comparison to IST. After that Addl.SE/MMTS, Mohali has checked the connection and found that RTC 14.12 and IST 13.52, whereas as per the report of DDL from 12.6.2015 peak load violation charges has been charged. As per the ESIM clause 132.3 and CC 4/2009 dt. 23.1.09 which has been noted to the consumer on dt. 7.4.2009 that if the RTC and IST difference is + 20 then peak load will be observed as IST. As per the checking of Sr.XEN/Enforcement, Mohali on dt. 2.7.2015 the drift between RTC 16.19 and IST 16.26 was 23 minutes and this was noted to the consumer. As per checking on dt.13.06.15 the drift was +20 minutes , So the committee has decided that peak load violation charges for 12.6.2015 are not chargeable and Peak load violation charges from dt. 13.6.2015 to 19.8.2015 is chargeable so the account of the consumer be overhauled accordingly.
