4.  ਵਰਨਣ The consumer was charged peak load exemption charges of Rs. 230850/- in bill of 04-2015 and Rs. 238545/- in bill of 05-2015. In the bill of 04-2015 the consumer was also charged Rs. 18230 as per half margin prepared by Internal Audit as per CC 44/2014. The consumer was also charged Rs. 95042/- by Computer Cell, Bathinda as per CC No. 44/2014 in bill of 04-2015. The consumer had considered all these amounts as disputed. Main contention of consumer was that it had applied for reduction of peak load on 31.03.2015 in the office of Sub Divisional Office, Ghubya and as per regulation 131.3 (V) of ESIM, the peak load exemption should have been reduced within the month, while it was reduced on 8.06.2015. As such the peak load exemption charges in the bills of 04-2015 and 05-2015 became disputed in the opinion of the consumer.
5.  ਫੈਸਲਾ The committee observed that the regulation 131.3 (v) of ESIM would have been applicable if the consumer had applied for reduction of peak load exemption directly to sanctioning authority (Chief Engineer, Power Purchase and Regulation, Patiala) and consumer had not applied for revision of status of continuous process plant. In this case the consumer had applied for reduction of peak load exemption and reduction of load of continuous process plant. As such the reduction of peak load exemption was clubbed with reduction in load of continuous process plant. Case of Consumer was sent to Chief Engineer, Power Purchase and Regulation, Patiala on 9.04.2015 through the proper channel after involving the office of Chief Engineer, West Zone, Bathinda. Chief Engineer, Power Purchase and Regulation duly reduced the peak load exemption and load of continuous process plant on 8.06.2015. Office of Chief Engineer, Power Purchase and regulation also clarified that there was no delay at the end of Chief Engineer Power Purchase and Regulation. The Committee decided that Regulation 131.3 (v) was not applicable in this case and consumer was correctly charged the peak load exemption charges in bills of 04-2015 and 05-2015.
