4.  ਵਰਨਣ The consumer was served notice of Rs. 635682/- on 12.06.2015 by Sub Division Office on the basis of half margin issued by the internal auditor dt. 8.06.2015. The was having load of Cold Storage as well as general load. The internal auditor found that since 2008 the consumer was charged MMC on the basis of general load from the period April to July every year while as per PSPCL regulations rate for the consumers having load of cold storage the MMC is chargeable on different specific rates. So half margin of recovery of Rs. 635682/- was prepared for the years 2008 to 2014. The consumer contended that the MMC should be charged only on the load attributable to the cold storage operations and that no recovery can be made after elapsing of two years of the date of billing.
5.  ਫੈਸਲਾ The presenting officer of the PSPCL submitted that there is no provision in the PSPCL regulations for charging of MMC only on the load attributable to cold storage operations. Presenting Officer also submitted that as per CC 5/2012 the amount which is not billed can be billed after elapsing of two years. The Committee agreed and decided that amount of Rs. 635682/- is correctly recoverable from the consumer.
