5.  ਫੈਸਲਾ This case, again, came up for hearing before the Committee on 07-06-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Ashwani Kumar Kalra appeared before the Committee on behalf of the consumer. He submitted reply/rebuttal as directed by the committee in the previous meetings, which was taken on record. The major arguments put forth by the representative of consumer are as under:- 1. The petitioner had observed Peak Load Hours Restrictions for complete 3 Hours as per old schedule declared vide PR circular 09/2003 and the change in PLHR timings as per PR 01/2015 were not got noted from him. 2 PSPCL vide CC No.25/2015 has issued instructions that “those consumers, who keep on observing previous Peak Load Restrictions timings in respective zones after 31.03.2015, shall not be penalized till the issuance of first bill of such LS consumers due to the genuineness of the problem”. The first bill after 31.03.2015 should mean here, the first bill intimating the consumer his first default containing the list of so called Peak Load Violations committed after 31.30.2015. The committee noted that PSEB (now PSPCL) vide PR circular No.03/2010 dated 18.3.2010 has issued instructions regarding Additional Power Regulatory Measures wherein it has also been prescribed that “the consumers are requested to download the information regarding Peak Load Restrictions/weekly off days from the PSEB (now PSPCL) website. They are asked to visit the website of the PSEB on regular basis in future. The consumers are also requested to watch newspapers for information.” The petitioner is an old consumer of PSPCL with huge sanctioned load of 2495 KW, as such he supposed to be very well aware of all the regulatory measures and change in Peak Load timings circulated by the PSPCL. Thus the submission of the petitioner that the instructions issued vide PR circular No.01/2015 were not got noted from him, as such he continued to observe peak load timings as applicable up to 31.03.2015, is not tenable. The ZDSC took note of the fact that the petitioner has violated PLHR only during 21 days (from 04.06.2015 to 04.08.2015) out of data available for 70 days, as per DDL dated 10.08.2015. Further, the first violation has been made on 04.06.2015, which lead to the conclusion that consumer was well aware of the peak load timings as circulated vide PR circular No.01/2015. The Committee also considered that CC No.25/2015 dated 16.06.2015 (referred to by the petitioner) whereby PSPCL provided relaxation, to those consumers who keep on observing previous peak load hours restriction timings in respective zones after 31.03.2015, by not penalizing till the issuance of first bill of such LS consumers (due to non-publicity instructions as issued vide PR circular No.01 dated 31.03.2015). The office of Chief Engineer/Commercial Patiala (SE/Sales-III) vide memo no. 68 dated 18.01.2016 (addressed to ASE/Op Lalru) clarified that the first bill in CC 25/2015 means the issuance of the first monthly bill of the financial year 2015-16. The first energy bill of financial year 2015-16 was issued to the petitioner on 9.4.2015, whereas first peak load violation has been observed on 04.06.2015. Further, the consumer has also made peak load violations even after 16.06.2015 (date of issue of CC No. 25/2015), as such he is not entitled to any relief in lieu of CC No.25/2015. Thus, in view of above facts, the ZDSC after detailed deliberations decided that the amount of Rs.12,15,225/- charged to the consumer against peak load violations from 04.06.2015 to 04.08.2015, is correct and recoverable. Further, the interest/surcharge be levied on the balance recoverable amount as per instructions of PSPCL.
