5.  ਫੈਸਲਾ This case again came up for hearing before the Committee on 07-06-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. The case was deliberated in the ZDSC. It was observed that all the relevant records pertaining to this case i.e. original store requisition for withdrawal of CT/PT, Meter sealing record, original consumer case, MCO/SJO/SCO, S.R./Challan vide which the meter was drawn from the ME Lab etc. could not be made available to the committee despite the efforts by Er. Jangbir Singh, Addl. SE at personal level. The Committee was thus left with the only checking report dated 30-7-2005 of Enforcement, wherein the capacity of meter has been mentioned as 200/5 Amps and rating of the CT/PT as 100/5 Amps. As per capacity of CT/PT unit & meter mentioned in this report, the billing of the consumer was required to be done with MF of 0.5 instead of 1(one). However, the date of installation of this CT/PT unit could not be ascertained from the record presented to the ZDSC. Keeping in view the above position, the Committee unanimously decided that the difference in billing due to wrong application of MF from 7/2005 to 6/2012 is refundable to the consumer. From 7/2012 the bills to the consumer are being issued by applying correct MF. The Committee further observed that as per the report dated 28-1-2013 of Enforcement, the supply of the consumer is on LT whereas sanctioned load is more than 100 KW and on the bills supply voltage has been printed as 11 KV. Sr. XEN/DS West Divn. Jalandhar vide letter No. 1608 dated 19-2-16 has confirmed that consumer has not been levied LT surcharge from 7/2003 onwards. The Committee, therefore also decided that LT surcharge from 7/2003 to-date (as applicable) be charged from the consumer as per instructions of PSEB/PSPCL. The refund due to excess billing from 7/2005 to 6/2012 (after adjustment of recoverable LT surcharge) be allowed through current energy bills alongwith interest as per instructions of PSPCL after pre-audit from AO/Field. Addl.SE/DS West Divn. Jalndhar vide letter No. 1608 dated 19-2-16 has confirmed that no action was taken on the checking dated 30-7-2005 of Enforcement due to which billing with wrong MF continued in this case. The Committee decided that the concerned officers/officials be proceeded against for lapses on their part by Dy. CE/DS Circle, Jalandhar. . The case is decided accordingly.

1 Tue 23, Feb 2016  This case, again, came up for hearing before the Committee on 23-02-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Matul Verma, Consultant is present on behalf of the consumer. Er. Jangvir Singh, Addl. SE/DS, West Division, Jalandhar is also present in the meeting. Er. Jangvir Singh Addl. SE/DS, West Division, Jalandhar has informed the Committee that whatever records were available in this case, copy of the same has been submitted to the Committee, which has been placed on record. Regarding the remaining documents he had stated that the records are not available.

Sh. Matul Verma, Consultant has stated that whatever documents are available with him, he has submitted the same to the Committee and further that he has no documents available with him in this case. The Committee directs Er. Jangvir Singh Addl.SE/DS Division West, Jalandhar to submit his specific report on para No. 11 of Committee’s proceedings dated 28-01-2016. The case is adjourned to the next date for further deliberations.

CE/DS Circle, Jalandhar is directed to get the CT ratio of the meter checked from Sr. Xen/Protection Division, Jalandhar and submit the report to the Committee Members within 7 days.
