5.  ਫੈਸਲਾ This case, again, came up for hearing before the Committee on 07-06-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Manohar Lal Engineer of the company was present on behalf of the consumer. The representative of the consumer argued that average units taken for overhauling the account for the disputed period are on the higher side, considering the consumption as recorded before and after the replacement of disputed meters. During discussion on the case, the representative of petitioner explained that additional instrument was installed at the time of extension in load from 14.76 KW to 19.99 KW, in 10/2011. He also apprised the committee that there is hospital on the first floor of the building where the connection of the petitioner in question, is installed. The representative of the consumer was asked to explain the reasons for decrease in consumption from 12/2011 onwards after increase in load from 10/2011. However, he could not explain anything regarding fall in consumption from 12/2011 onwards, as compared to previous period. The committee observed that although the ‘D’ code (meter defective) was reported by the meter reader in6/2012 but the fall in consumption from 12/2011 can be attributed to defect in the meter. The defective meter was replaced on 24.9.2012. The meter installed on 24.9.2012 again became defective and was replaced on 1.2.2014. The committee also observed that account of the petitioner has been overhauled on the basis of consumption as recorded/adopted during the corresponding period of previous year, after enhancing the same proportionately with the increased load, as per instructions of PSPCL. Further, account for 6/2012 has not been overhauled as the regular bill for matching average units had already been issued to the consumer. The decrease in actual recorded consumption after 2/2014 was not considered as the use of supply for hospital in the same building from the connection of the petitioner is not ruled out. Although there is no documentary evidence in this regard but the consumption was bound to increase after extension in load (considering the fact that supply is used for mobile phone tower and consumption remains consistent in such like connections ) whereas fall in consumption is there from 12/2011 onwards. The case was deliberated at length. The calculations as worked out by the Audit Party were also discussed in detail in the presence of the representative of the consumer. After considering all the above facts of the case, the ZDSC unanimously decided that the amount charged is justified and recoverable from the consumer. The case is decided accordingly.

Proceeding:-This case came up for hearing before the Committee on 29-04-2016. Er. Gopal Sharma, Dy. CE/DS Circle, Jalandhar presented the case before the Committee. Sh. Manohar Lal Engineer is present today on behalf of the consumer. He has produced the Power Attorney which has been placed on record. He has further submitted that formerly it was known as Spice Communication Ltd. And has its account No. ET21/1426 and that the amount in dispute concerns the said unit which has been taken over by M/s Viom Net Work Ltd. He has submitted the representation which has been placed on record. A copy of the same has been supplied to Dy.CE/DS Circle, Jalandhar for comments within 7 days to the Committee with a copy to the Consumer for his rebuttal within 10 days thereafter. The case is adjourned accordingly to the next date.
